FBO SOLE SOURCE NOTICE VA259-13-AP-1949 / 554-13-3-4400-0957 LAB ANIMAL VET SERVICES Solicitation #: VA259-13-R-0575 Notice Type: Sources Sought NAICS: 541940 Veterinary Services; $7.0 MIL PSC: R416 Veterinary Services Synopsis: Under the authority of 41 USC 253(c)(1) and FAR 6.302-1, the NCO 19 Rocky Mountain Acquisition Center, Glendale, CO, proposes to enter into a non-competitive commercial items contract with the Colorado State University Sponsored Programs, Campus Deliver 2002, Fort Collins, CO 80523-2002, to provide a licensed academic veterinarian to serve as a veterinary consultant to the BA Eastern Colorado Health Care System. Contractor's unique characteristics include: extensive knowledge of the Animal Welfare Act and Public Health Service Policy on Humane Care and Use of Laboratory Animals, specialized training in laboratory animal medicine, certification in working with laboratory animals, faculty appointment at an institutional department specializing in laboratory animal care and engagement in post graduate work in laboratory animal care. A Statement of Work with duties, and special requirements (e.g. certifications and licensing) is attached to this notice. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within the due date for receipt of proposals will be considered by the Government. A Determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. STATEMENT OF WORK The contractor agrees to provide Veterinary Services to the VA Eastern Colorado Health Care System in accordance with the terms, conditions, provisions, and schedule contained herein. a. Attending veterinarian services shall be provided by a licensed academic veterinarian engaged in post-graduate work, specializing in laboratory animal care (Attending Veterinarian). Such individual shall hold a faculty appointment at an accredited veterinary school and have in depth knowledge of the Animal Welfare Act and Public Health Service Policy on Human Care and Use of Laboratory Animals, as well as, specialized training in laboratory animal medicine. In addition to the primary awardee, post-graduate veterinary trainees in laboratory animal/comparative medicine will provide day to day veterinary clinical care, will be voting members of the IACUC, and will consult on matters pertaining to the VA ECHCS Animal Care program (Clinical Veterinarian). b.The following services shall be provided by the Attending Veterinarian: (1)Establish and maintain proper measures to ensure the appropriate care and use of all animals involved in research, research training, and biological testing activities conducted or supported by Public Health Service (see subpara. 3m) (2)Serve as signatory veterinary medicine consultant to the VA ECHCS animal welfare program in accordance with the Animal Welfare Act. (3)Participate in two semi-annual facility laboratory inspections annually, as part of the semi-annual program review. (4)Attend semi-annual meetings with the facility Director to review results of the semi-annual review. (5)Otherwise perform site visits or attend IACUC meetings approximately quarterly. (6)Participate in all oversight and accreditation visits, to include but not limited to, AAALAC, VA Office of Research Oversight, and Office of the Inspector General. (7)Oversee activities of the Clinical Veterinarian, and provide mentorship, guidance, and advice about activities requiring additional expertise. (8)Participate in meetings relating to planning a new animal research facility through project completion. (9)Maintain a Colorado DVM license with ability to purchase veterinary pharmaceuticals through a pharmaceutical company. (10)Be available for emergency unforeseen circumstances, consultation on changes in regulatory guidance, potential reportable incidents, and other events requiring Attending Veterinarian input and expertise. (11)Be available as back up and consultant for points # c1, c2, c3, c4, c5, c6, c7, c8, c. The following services shall be provided by the Clinical Veterinarian: (1)Be Available by phone or e-mail for medical questions/concerns from the VMU supervisor/staff/principal investigators (PIs) and laboratory technicians (2)Be available by phone or e-mail for procedural questions/concerns relating to all aspects of the animal welfare program, such as the Institutional Animal Care and Use Committee (IACUC) standard operating procedures, facility management issues, etc. (3)Represent Eastern Colorado HCS at monthly IACUC meetings. (4)Perform pre-veterinary consultations for animal protocols as required by VHA Handbook 1200.07. (5)Perform initial and annual reviews of animal protocols prior to monthly IACUC meetings and enter reviews into the LAMBS program to ensure compliance with Animal Welfare Act. (6)Perform review of protocol revisions prior to the monthly IACUC meetings. (7)Participate in the post-approval monitoring program of animal protocols. (8)Be available to participate in points # b1, b3, b4, b6, and b8 as possible. SPECIAL CONTRACT REQUIREMENTS 1.SERVICES: a.The services specified in the Sections entitled Schedule of Supplies/Services and Special Contract Requirements may be changed by written modification to this contract. The modification will be prepared by the VA Contracting Officer. b.Other necessary personnel for the operation of the services contracted for at the VA will be provided by the VA at levels mutually agreed upon which are compatible with the safety of the patient and personnel and with quality medical care programming. c.The services to be performed by the contractor will be performed in accordance with VA policies and procedures and the regulations of the medical staff by laws of the VA facility. d.The services to be performed by the contractor will be coordinated with the Associate Chief of Staff for Research and Development. e.This contract is a nonpersonal health care services contract as defined in Federal Acquisition Regulation 37.101 and is as follows-"Nonpersonal services contract means a contract under which the personnel rendering the services are not subject, either by the contract's terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees". f.The Government may evaluate the quality of professional and administrative services provided, but retains no control over the medical professional aspects of services rendered (e.g., professional judgments, diagnosis for specific medical treatment). 2.TERM OF CONTRACT: This contract is effective July 1, 2013, plus four (4) one year options for renewal, which may be exercised by the VA. No services are to be performed after September 30th of each year until the contracting officer authorizes such services in writing. Should circumstances arise that would significantly affect the scope of work or possibly inhibit the contractor from performing the services described in this contract, the contractor shall immediately submit in writing to the Contracting Officer a request for change in accordance with FAR 52.212-4 CONTRACT TERMS AND CONDITIONS-COMMERCIAL ITEMS (FEB 2007). Upon receipt of such request, the Contracting Officer will work with the contractor to obtain a fair and reasonable solution. 3.QUALIFICATIONS: The veterinarians performing under this contract are required to be Board Eligible or Board Certified and shall be licensed in a State, Territory, or Commonwealth of the United States or the District of Columbia. All licenses held by the personnel working on this contract shall be full and unrestricted licenses. The qualifications of such personnel shall also be subject to review by the Institutional Animal Care and Use Committee (IACUC) and approval by the Research and Development Committee. 4.CREDENTIALING AND PRIVILEGING: The Contractor is responsible to ensure that proposed staff possesses the requisite credentials, including licensure as outlined in paragraph 3 above and certification of training in laboratory animal medicine, which is a recognized specialty within veterinary medicine that requires special training and experience. 5.CONFLICT OF INTEREST: The contractor shall not propose who is also an employee of the ECHCS if the employment of that person would create an appearance of conflict of interest. A Government employee who is employed by a Contractor is prohibited from participating personally and substantially on behalf of the Government through decision, approval, disapproval, recommendation, rendering of advice, certifying for payment or otherwise in that contract. No VA employee who is an employee, officer, director, or trustee of an affiliated university, or who has a financial interest in the contract, may lawfully participate in a VA contract or any other Government contract with the university. Authority: Title 18 U.S.C. Section 208(a), and Title 5 Code of Federal Regulations (CFR) Section 2635.402. See attachment, VHA Handbook 1660.3 (see http://www1.va.gov/vhapublications/ViewPublication.asp?pub ID=396). 6.KEY PERSONNEL AND TEMPORARY EMERGENCY SITUATIONS: The Contractor shall assign to this contract the following key personnel: Dr. Sue VandeWoude a. During the first 90 days of performance, the Contractor shall make NO substitutions of the key personnel in place during the time of contract transition unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer, in writing, within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (b) below. After the initial 90-day period of the contract, the Contractor shall submit the information required by paragraph (b) to the Contracting Officer at least 15 days prior to making any permanent substitutions. b.The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes shall have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on the proposed substitutes. The contract will be modified to reflect any approved changes of key personnel. c.For temporary substitutions where the key personnel will not be reporting to work for three (3) consecutive work days or more, the Contractor will provide a qualified replacement for the key personnel. This substitute shall have comparable qualifications to the key person. Any period exceeding two weeks will require the procedure as stated above. d.The Contractor cannot change key personnel without VA approval and when changes in key personnel are approved, the contract prices shall be adjusted according to reflect the salary and benefits of the person actually providing the services. Clinical Veterinarian Clinical veterinarians will be appointed on a rotating basis, typically during their first or second year of a three year residency. Overlap between residents may occur for approximately 6 months to allow training of a new resident. A new resident will typically be appointed every 1.5-2 years. Payment to clinical veterinarians will be issued via supplemental pay by CSU and VA ECHCS has no concerns with this. Continuity of Services. The Contractor shall ensure that qualified backup providers are available to provide coverage during scheduled and unscheduled absences to primary contract providers. 7.QUALITY ASSURANCE: Contractor personnel shall be subject to the same quality assurance standards in meeting or exceeding current recognized National Standards as established by the Association for Assessment and Accreditation of Laboratory Animal Care (AAALAC) International. Contractor shall perform services in accordance with the ethical, professional and technical standards of the veterinary medicine industry as consistent with VA Policy, regulations and procedures. Personnel provided by the Contractor shall be technically proficient in the skills necessary to fulfill the Government's requirements, including the ability to speak, understand, read and write English fluently. They shall not introduce new procedures or services without prior recommendation to and approval of the IACUC, Associate Chief of Staff for Research (ACOS/Research) and Research and Development Committee. 8. CONTRACT PERFORMANCE MONITORING: The COTR shall designate appropriate ECHCS personnel to monitor contractor employee work hours/services through one or a combination of the following mechanisms: (a)The Clinical Veterinarians are required to submit a time and attendance sheet to the COTR on a monthly basis. (b)Documentation of services performed will be reviewed prior to certifying payment. The COTR will perform periodic spot checks and document to ensure records monitoring. VA will pay only for services actually performed at VA, and in strict accordance with the schedule of prices/costs shown in the Schedule of Items. All contract monitoring documentation and data is subject to review by the Contracting Officer at any time. (c)The using service, through the COTR, will provide a written statement annually to the Contracting Officer to include a summary of contractor actions and a statement that all requirements of the contract have been fulfilled as agreed. The summary evaluation will be submitted 60 days prior to expiration of the contract (and/or prior to election of option year renewals if applicable). (d)If the COTR finds that the contractor is not performing at the required level shown in the schedule, the Contracting Officer will determine the proper deductions from the contract. 9.OTHER SPECIAL REQUIREMENTS: The contractor shall be responsible to ensure that contractor employees providing work on this contract are fully trained and completely competent to perform the required. The Contractor shall be in compliance with applicable Federal (PHS and VHA) requirements, to include but not limited to all health screenings, vaccinations, etc. 10.POINT OF CONTACT: Contractor shall provide a point of contact that shall be responsible for the performance of the work. The point of contact shall have full authority to act for Contractor on all matters relating to the daily operation of this contract. Contractor shall designate this individual, in writing to the Contracting Officer before the contract start date. An alternate may be designated, but the Contractor shall identify those times when the alternate shall be the primary point of contact. 11.ABSENCES: The payment for any leave, including sick leave, holiday, or vacation time, in excess of authorized absences, is the responsibility of the Contractor and appropriate coverage in accordance with the contract terms and conditions must be supplied by the contractor. The contractor's employee must be present at the VA Medical Center (VAMC) and must be actually performing the required services for the period specified in the contract. Payment for services performed at the VAMC will be paid at the rates established in the Schedule of Prices. 12.WORK HOURS: The services covered by this contract shall be furnished by the contractor as defined herein. Hours worked will be determined by the needs of the animal care and use program, which can be changed based on census of animals, type of research being conducted, and other variable factors. Emergency services may be required in rare instances.
