- The U.S. Nuclear Regulatory Commission intents to issue a sole source purchase order under the authority of 13.106-1(b) to: DrugPak, LLC. P.O. Box 51174 Knoxville, TN 37950-1174 For the following brand name software: Product: DrugPak Version: 6.x Vendor: DrugPak - Small Business Website: http://www.drugpak.com/ 1) Background The U.S. Nuclear Regulatory Commission (NRC) is an independent Federal agency established by the Energy Reorganization Act of 1974 to regulate civilian use of nuclear materials. NRC's mission is to regulate the nation's civilian use of byproduct, source, and special nuclear materials to ensure adequate protection of public health and safety, to promote the common defense, security, and to protect the environment. The Office of Administration (ADM), Division and Facilities and Security (DFS), Personnel Security Branch (PSB), is responsible for the overall management of the federally mandated NRC Drug Testing Program. Currently, there are three (3) separate applications used to track and manage the drug testing program and create random drug test pools. EDTTS is an outdated Clipper database that creates random drug test pools and track results for NRC employees. EDTTS was tested in the Consolidated Test Facility with Windows 7 and will not work in that operating system. Randomware is a COTS software package that is used to create random drug test pools for contractors. IPSS was supposed to replace EDTTS but was not implemented fully. IPSS will be replaced by the Personnel Security Adjudication Tracking System (PSATS) and the drug testing program will not be part of that system. 2) Scope of Work The objective of this acquisition is to purchase commercial item software licenses and services to replace the current 3 applications supporting the drug testing program with a single solution for creating random drug test pools and tracking drug test results for employees and contractors. This will improve functionality, data integrity and reporting capabilities for managing the Drug Testing Program. DrugPak will provide the NRC with Case Management software licenses for 5 concurrent users configured for end-to-end recording, tracking, and processing drug test cases and creating random drug test lists that meet the general feature requirements. They will also provide technical and user documentation for software which will include all special configurations required during installation of hardware and software, database configuration, and network. DrugPak will also provide software maintenance, upgrades, new releases, data conversion, over the phone Consulting Services, custom programming, and provide one training session onsite at the NRC that shall last no more than 8 hours at NRC Headquarters in Rockville, MD. 3) Period of Performance Base Year - June 1, 2012 - May 30, 2013 Option Year 1 - June 1, 2013 - May 30, 2014 Option Year 2 - June 1, 2014 - May 30, 2015 Option Year 3 - June 1, 2015 - May 30, 2016 Option Year 4 - June 1, 2016 - May 30, 2017 4) Justification The NRC is procuring DrukPak 6.0 on a sole source basis because no other software product has been found to meet the following salient physical, functional, or performance: 1. Configurable commercially available case management software solution configured for end-to-end recording and tracking of personnel drug testing cases from intake, case entry processing, random drug testing test pools and test groups generation, entering test results, review and reporting. 2. The software must run in the Windows 7 operating system. 3. Web-based software that is compatible with Internet Explorer 8.x or above. 4. The system shall have an internal random number generation logarithm that is in compliance with CITE 49CFR382.305 Subpart (i) (Department of Transportation TITLE 49) "(i) The selection of drivers for random alcohol and controlled substances testing shall be made by a scientifically valid method, such as a random number table or a computer-based random number generator that is matched with drivers' Social Security numbers, payroll identification numbers, or other comparable identifying numbers. Under the selection process used, each driver shall have an equal chance of being tested each time selections are made." 5. The system shall allow the user to import the employee data file into the database. 6. The system shall allow the user to input biographical and employment information for NRC Applicants and Contractors for drug testing prior to starting employment. 7. The system shall uniquely identify each case within DTTS by generating a required master case number that is associated with all activities related to the person. 8. The system shall automatically generate "Test Groups" separating each employee into a test group based on their NRC Locale code. 9. The system shall allow the user to select an entire NRC Remote Site as a "Test Group". 10. The system shall generate selected number of test pools per year. 11. The system shall allow the user to tailor drug pools by selecting the percentage of employees to test for drugs and then select the frequency at which the selection should be randomized. 12. The system shall automatically generate a list of randomly selected names of people to be tested based on the percentage provided. 13. Reporting to identify missed candidates within the random pool 14. The system shall generate a separate list for NRC Contractors. 15. The system shall track individual drug test results. 16. The system shall maintain the results of each drug test for a period specified by the user. The system shall generate individual follow-up testing schedules with user-specified parameters. 17. The system shall generate individual follow-up testing schedules with user-specified parameters. 18. The system shall be able to create, maintain and protect from modification to unauthorized access or destruction and audit trail of accesses to the objects it protects. The audit data shall be protected so that read access to it is limited to those who are authorized. 19. Software cannot be a cloud base solution. The required software is proprietary and exclusive to DrugPak. Further, DrugPak has no authorized resellers of their software, and does not authorize any other firm to maintain or make adjustments to its very specialized software product.
