DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 12, Great Lakes Acquisition Center, 115 South 84th Street, Suite 101, Milwaukee, WI 53214-1476. Transaction number 695-13-3-081-5525. 2.Nature and/or Description of the Action Being Processed: This is a request for Other Than Full and Open Competition for emergency procurement of disposable instruments to be used with the DaVinci Robot. This procurement will proceed on a firm-fixed price, sole source basis with Intuitive Surgical Inc.in the estimated amount of $101,360.00. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The VA Milwaukee has a urgent requirement for the procurement of disposable instruments to be used with the DaVinci Robot. The instruments are required to use with the DaVinci Robot surgical system. 4. Statutory Authority Permitting Other than Full and Open Competition: Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements Per FAR 6.302-1 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): In addition to the urgent nature of the request DaVinci Robotic surgical system is the only robotic system available on the market. Additionally, Intuitive Surgical, Inc. has the only patient granted by the FDA for the DaVinci Robtic surgical system. DaVinci Robotic surgical system is recognized for its superior 3D, high definition vision with patented instrumentation allowing for enchanced dexterity, precision and control. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Not applicable as Intuitive Surgical, Inc. is the only patient holder for this system. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The contract specialist contacted Intuitive Surgical Inc. and confirmed pricing was "list pricing". 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Contracting specialist searched under google nothing came up. Additionally Intuitive Inc. is the sole manufacturer of this product. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: No other facts are required to support the use of Other Than Full and Open Competition. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: None. 12.
