Description
Pre-Solicitation Notice This is a notice of intent, not a request for a proposal. The National Institutes of Health (NIH), intends to award a contract for the Office of Research Information Systems (ORIS) for the use of software license subscription, support services and maintenance for Elsevier (formerly Collexis) software currently in use by the Research, Condition, and Disease Categorization (RCDC) System and additional use as warranted by the NIH community and in concert with other government agencies. The objective of this contract is to provide the RCDC system and the NIH community in concert with other government agencies Elsevier specific software license subscription and maintenance services for such software. RCDC seeks a sole source contract with Elsevier to provide the software license subscription and maintenance services. The Contractor shall provide software license subscription and maintenance services for the RCDC System. RCDC related tasks include the following: • Provide for the use of the Elsevier Fingerprint Engine software license subscription for the RCDC system. • Provide software maintenance services as follows on an as needed basis: (1) Error Correction. Elsevier shall exercise commercially reasonable efforts to correct any Error reported by RCDC in the Previous Sequential Release, Previous Sequential Version or the then current Release or Version and in accordance with the priority level assigned by Elsevier to such Error as follows: (i) Level 1 Errors - Elsevier will commence an investigation of a Level 1 Error within four (4) hours written notice by RCDC and initiate the development of Error Corrections immediately thereafter. Elsevier shall promptly commence the following procedures: An example of a Level 1 Error would be an incorrect line code. (A) Assign Elsevier engineers to correct the Error; (B) Notify RCDC management that such Errors have been reported and of steps being taken to correct such Error(s); (C) Provide RCDC with periodic reports on the status of the corrections; and (D) Initiate work to provide RCDC with a Fix or, if agreed upon by RCDC, a Workaround. (ii) Level 2 Errors - Elsevier will commence an investigation of a Level 2 Error within forty-eight (48) hours of notice by RCDC and initiate the development of Error Corrections immediately thereafter. Elsevier shall exercise commercially reasonable efforts to provide an Error Correction to RCDC. Elsevier shall exercise commercially reasonable efforts to include the Error correction for the Error in the next Software Release. An example of a Level 2 Error would be when the system is malfunctioning. (iii) Level 3 Errors - Elsevier will commence an investigation of a Level 3 Error within fifteen (15) days of notice by RCDC and initiate the development of Error Corrections immediately thereafter. Elsevier will exercise commercially reasonable efforts to provide an Error Correction to RCDC. Elsevier shall exercise commercially reasonable efforts to include the Error correction for the Error in the next Software Release. An example of a Level 3 Error is when the system stops functioning and is no longer accessible. Examples cited above are meant to demonstrate potential level of errors and are not meant to be an exhaustive list. (2) Telephone Support. Technical support telephone assistance provided by Elsevier to RCDC's designated technical support personnel during normal business hours concerning the installation and use of the Previous Sequential Release, Previous Sequential Version or the then current Release or Version in accordance with the Documentation relating thereto. Normal business hours are 8 a.m. to 5 p.m. CET. (3) Maintenance Unrelated to the Software. If Elsevier believes that a problem reported by RCDC may not be due to an Error in the Software, Elsevier will notify RCDC in writing.
