Attachment 2 - Specifications Attachment 1 - Package to be submitted to the Forest Service Attachment 3 - Maps COMMERCIAL COMBINED SYNOPSIS/SOLICITATION(under $150,000) (Updated through FAC 2005-66, Effective April 1, 2013) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number AG-05M6-S-13-0019 is issued as a Request for Proposal (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-66, Effective April 1, 2013. This is a small business set-aside with an associated NAICS code of 423320 and small business size standard of 100 Employees. STATEMENT OF WORK Gletty Pit Stockpiling contract is for hauling and stockpiling 4,000 tons of crushed aggregate 703 gradation B as a base item (Item No. 32002), and 2000 tons of crushed aggregate 703 gradation B as an optional item (Item No. 32002A). This includes the required equipment for the proper placement of crushed aggregate at the stockpile location. The stockpile location is 0.6 mile on the Forest Road 4300104 (Gletty Pit). The stockpile construction will follow contract 320 specifications provided under Attachment 2 - Specifications. LOCATIONOF GLETTY PIT From Usk, WA travel west 1.2 miles on Beeman Rd/Mckenzie Rd Turn right on McKenzie Rd for 1.1 miles Turn right on Westside Calispell Rd for 1.6 miles to Flowery Trail Rd for 6.0 miles Turn right on Forest Road 4300104 for 0.6 miles to pit location APPLICABLE CLAUSES AND PROVISIONS (by reference and by full text) FAR 52.212-1 Instruction to Offerors-Commercial (FEB 2012) This provision is cited by reference only. The offeror is required to review and understand the terms and conditions of this provision. FAR 52.212-2 Evaluation-Commercial Items (JAN 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: 1) Price; and 2) Delivery Schedule. In accordance with FAR 15.304, the Delivery Schedule is approximately equal to Price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. No. 112-74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it - (1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and (2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government. (b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434. WASHING OF EQUIPMENT Pollutants such as fuels, lubricants, bitumen, raw sewage, and other harmful materials shall not be discharged on the ground; into or nearby rivers, streams, or impoundments; or into natural or man-made channels. Wash water or waste from concrete or aggregate operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged. The Contractor shall wash all equipment except for hauling vehicles prior to entering National Forest Land. Remove all soil which could contain noxious weed seed. Remove grease and oil from drive mechanisms which would be discharged into the stream when equipment is operating. Prior to transporting equipment to the site, assure that the equipment's hydraulic, lubrication and fuel systems are free from leaks.
