DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 6, Network Contracting Office, VA Medical Center, Hampton, Virginia. The 2237 number is 558-13-2-056-0035. 2.Nature and/or Description of the Action Being Processed: This is a sole source justification for the procurement of Myriad Genetic Laboratories, Inc. BRACAnalysis ® Genetic Breast and Ovarian Test for VAMC Durham, NC. 3.Description of Supplies/Services Required to Meet the Agency's Needs: VAMC Durham requires: "8 BRACAnalysis ® Genetic Test $26,720.00 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This is a "Sole Source Justification" for "Myriad Genetic Laboratories, Inc. BRACAnalysis ® is a genetic test that confirms the presence of BRCA1 or BRCA2 gene mutation by the submission of a blood test or oral rinse sample from the patients' provider. The facility specializes in providing genetic diagnostic test for breast and ovarian cancer accredited by the College of American Pathologists and has CLIA (Clinical Laboratory Improvement Amendments) accreditation. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The BRACAnalysis ® Genetic Test is a proprietary testing only performed at Myriad Genetic Laboratories, Inc. "Sources Sought" notice was published from 04-22-13 through 04-29-13 with salient characteristics of required test that concluded with no other responses. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated price of $26,720.00 to the Government (a 5% increase from 2012's cost) has been determined fair and reasonable by the Contracting Officer. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Sources Sought notice was published from 04-22-13 through 04-29-13 with salient characteristics of required test that concluded with no other responses. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: "Sources Sought" notice was published from 04-22-13 through 04-29-13 with salient characteristics of required test that concluded with no other responses. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: "Sources Sought" notice was published from 04-22-13 through 04-29-13 with salient characteristics of required test that concluded with no other responses. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Market research will be conducted for subsequent acquisitions to ensure fair and open competition.
