- Amendment 0001 This is a combined synopsis/solicitation for commercial services prepared for the purchase of marketing and communications consulting services in support of the SEC Office of Minority and Women Inclusion, in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice and the attached Performance Work Statement (Attachment 1). This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is SECHQ113R0010 and is issued as a request for proposal (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-66. The NAICS code associated with this procurement is 541613 Marketing Consulting Services with a size standard of $14,000,000.00. This is an Economically Disadvantaged Women Owned Small Business set-aside. Respondents shall follow the contract line item number (CLIN) structure detailed in the attached pricing schedule (Attachment 2). The Period of Performance is for one base year and two option years. The anticipated award date is June 1, 2013. The place of performance is at the contractor's facility for the SEC Headquarters located at 100 F. Street NE Washington DC, 20549. The following FAR provisions apply to this acquisition: 52.212-1 Instructions to Offerors (Feb 2012). The following submission instructions also apply: Each Offeror shall submit an electronic version of its proposal via email to Takela Morris at morrist@sec.gov and carbon copy (cc) Regina Mumford Rush at Mumford-RushR@sec.gov. Proposals are due no later than 1:00 PM Eastern Standard Time, on May 28, 2013. LATE OFFERS MAY NOT BE ACCEPTED. Questions regarding this Request for Proposal must be submitted in writing and sent via email to the attention of Takela Morris at morrist@sec.gov and carbon copy (cc) Regina Mumford-Rush at Mumford-RushR@sec.gov no than 1:00 PM Eastern Standard Time, on May 13, 2013. Questions received after that date/time may not be addressed. Questions and answers will be posted on later than May 24, 2013. All offers must include the following information (preferably to be provided on the offer cover letter (not included in the page limitation): a) Dun & Bradstreet Number (DUNS) b) Contact Name c) Contact Email address d) Contact telephone and fax number e) Complete business mailing address The Offeror's technical proposal (Volume 1) must demonstrate the firm's capability to perform the requirements outlined in the Performance Work Statement. Offerors shall provide a technical offer that includes the following two (2) general areas/factors: Factor 1, Technical Approach and Understanding; Factor 2, Past Performance. VOLUME 1 - TECHNICAL PROPOSAL: The Offeror's technical submission should demonstrate the firm's capability to perform the requirements outlined in the Performance Work Statement (PWS). Offerors shall provide a technical proposal that includes the following two (2) general areas/factors: A. Technical Approach and Understanding B. Past Performance Technical Approach and Understanding The Offeror must identify and describe their technical approach that satisfies the requirements defined in the PWS. The Offeror's technical approach should include the following: 1) discussion of the background, objectives, and tasks/ objectives of the PWS; 2) discussion of proposed methods and techniques for completing each task; 3) discussion which supports how each task will be evaluated for full performance and acceptability of work from the Offeror's perspective; and 4) discussion of any anticipated major difficulties and problem areas, along with potential recommended approaches for their resolution. The Offeror shall submit a Draft Outline of its proposed marketing strategy. Proposals must demonstrate that both your firm and personnel can successfully complete this project. Page Limitation: The technical proposal submission shall be limited to fifteen (15) one-sided pages, excluding the cover page and table of contents. Offerors shall not include any price information in the technical proposal. Past Performance: Offerors shall provide a list of no more than three current or past contracts (both Government and Commercial) performed within the past five years for whom the Offeror has provided the same or similar services. The contractor shall submit the following information for each contract: 1. Name of agency 2. Contract number 3. Contract type 4. Total contract value 5. Description of the contract work, specifically addressing the relevance of the work, including examples of taglines, description of strategies, etc. 6. Contracting Officer's or similar representative's telephone number and e-mail address. 7. List of all disputes associated with the contract. 8. List of options that were not exercised and reason(s) why they were not exercised. 9. Problems encountered and how they were resolved. In accordance with FAR 15.305, in the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the Offeror will not be evaluated either favorably or unfavorably in this area, but instead will receive a neutral rating in the area of past performance. VOLUME 2 - PRICE PROPOSAL: Each Offeror shall submit a price proposal separate from the technical proposal. The price proposal shall include the following: a) Completed Tables below Table 1 and Table 2 in Excel. b) Fixed hourly rates shall be fully burdened and include all costs (direct and indirect), overhead, and profit. c) If applicable, Subcontractor and/or Partner Supporting Documentation. Subcontracting are permissible under this RFP. d) Offerors shall provide a list of labor categories, descriptions, and proposed discounted hourly rates to perform the overall scope of the IDIQ contract in Table One below. e) Offerors shall provide a proposal for the following scenario in Table Two: Provide all deliverables within 90 days of contract award. Offerors shall use their independent judgment in determining their proposed labor categories and labor mix. The pricing for this scenario will be utilized by the Government for evaluation purposes and may be utilized as a proposal for the first task order. EVALUATION CRITERIA AND BASIS FOR AWARD The Government intends to evaluate the responses received, make a best value determination, and place the order with the contractor that represents the best value. It is anticipated that a single award will be made to the responsible offeror submitting an overall proposal that is determined most advantageous to the Government, price and non-price factors considered. Award(s) will be made to the offeror(s) whose proposal meets the Government's requirements and whose technical proposal and price represent the best value to the Government. offeror(s) are cautioned that their initial proposal should contain the best terms from a technical and price standpoint. The failure of a offeror to meet any given requirement of the RFP in their proposal may result in the entire proposal being found to be unacceptable and thus eliminated from the competition. The Government reserves the right to make no award pursuant to this proposal. The evaluation of proposals will be based on the following factors: 1. Technical Approach and Understanding 2. Past Performance 3. Price (non-rated) Technical Approach and Understanding is more important than Past Performance. When combined, the technical evaluation factors of (1) Technical Approach and Understanding and (2) Past Performance are significantly more important than price. As the technical proposals become more equal, price becomes more important in making the award determination. In the event that two or more proposals are determined not to have any substantial technical differences (i.e. are technically equivalent), award(s) may be made to the lower priced proposal. It should be noted that award may be made to other than the lowest priced proposal if the Government determines that a price premium is warranted due to technical merit. The Government may also award to other than the highest technically rated quotation, if the Government determines that a price premium is not warranted. Offerors must submit a completed copy of the provision at FAR 52.212-3 Offeror Representations and Certifications -- Commercial Items (Dec 2012) with its offer unless the offeror has Representations and Certifications entered into the ORCA database at https://www.acquisition.gov/far/. Offerors that fail to furnish the required representation information, or reject the terms and conditions of the combined synopsis/solicitation, may be excluded from consideration. When the Government requires supplies or services covered by this contract in an amount of less than $1,000.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor- (1) Any order for a single item in excess of $650,000.00; (2) Any order for a combination of items in excess of $650,000.00; or (3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section. (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section. (d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 10 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source. (End of clause) 52.216-22 Indefinite Quantity (Oct 1995) (a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract. (b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum." (c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations. (d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after three years of award of contract. (End of clause) As referred to in paragraph (b) of FAR Clause 52.216-22, "Indefinite Quantity" of this contract, the contract minimum quantity is establish at $1,000.00. The contract maximum quantity is hereby established at the total amount of $650,000.00.
