Description
Limited Sources Justification and Approval Limited Sources Justification and Approval In accordance with FAR 8.405-6(c) the following is provided - 1. Identification and Description of Action Being Approved On behalf of GSA Region 9 Laguna Field Office, the following justification for other than full and open competition is submitted by the Los Angeles Service Center, Public Buildings Service, General Services Administration (GSA), in support of the action taken to remediate damages caused by water leak at the Chet Holifield Federal Building, 24000 Avila Blvd., Laguna Niguel, CA. The immediate solution is to procure for emergency services from ABM Janitorial Services - Southwest, Inc. under Federal Supply Schedule 03 FAC "Facilities Maintenance and Management". The Scope of work includes the removal & clean up due to the water intrusion that occurred over the weekend of March 23, 2013, which affected approximately 110,000 square feet of building space on the first, second, and third floors. The water leak was discovered by the O&M contractor, ABM Janitorial Services - Southwest (ABM) on March 23, 2013, who notified Property Manager / Contracting Officer Sherry Hutchinson. Ms. Hutchinson met with ABM at approximately 11:00 AM and directed ABM to begin water leak remediation services not to exceed her warrant limit under the O&M Task Order Additional Services provision for ordering services on March 23, 2013 under Contract No. GS-06F-0069N, Order No. GS-P-09-09-KS-0049. However, by Monday, March 25, 2013, the estimated cost for the water leak remediation services was going to exceed the order limitation for the O&M contract and was communicated to the Ms. Hutchinson. Due to the amount now exceeding the warrant authority of Ms. Hutchinson's warrant, it was decided to elevate the requirement to the Los Angeles Service Center for continued action, because it was in the best interest of the Government to continue with the water remediation services. Although the original intent was to issue an additional services order against ABM's existing Contract (no order was was issued) under the same FAS Schedule vehicle, it was decided the best approach was to have the Los Angeles Service Center issue a confirming order for the services, since this office possesses Contracting Officer's with higher warrants. 2. Description of Supplies or Services Required The contractor shall provide management, supervision, manpower, equipment and supplies necessary to provide emergency water leak remediation services and repairs at the Chet Holifield Federal Building to ensure the support required for the safety of our customers, and minimize the risks of additional time induced water damage to the building. The estimated price for the remediation services is approximately $780,000. 3. Identification of Statutory Authority The following statutory authorities are offered as justification for acquiring the referenced services under the restricted competitive conditions: FAR 8.405-6(a)(1)(i)(A) Urgent and Compelling Need Exists, and following the ordering procedures would result in unacceptable delays. 4. Identification of the justification rationale (see 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service : The presence of over 15,000 gallons of water within tenant space in this building poses the need for immediate action. Industrial Hygiene protocols identify flood waters inside a building beyond 48 hours as an elevating hazard to human health. These protocols also require monitoring and testing of all such spaces before re-tenancy to ensure the safety of tenants. Remediation standards require the drying of all spaces and materials as soon as possible to mitigate the risk and extent of the growth of hazardous molds and fungi. The presence of unhealthful molds and fungi in tenant space would necessitate curtailment of the timely accomplishment of the missions of the CIS in the processing of applications for citizenship and the timely resolution of inquires pending with the IRS. The untimely performance of these missions would result in irreparable harm to the United States in the trust of citizenry for the fair and timely administration of the functions of Government. It would also result in additional economic loss to the United States associated with the need for additional borrowing for the duration that funds were not being collected pending resolution of disputes/inquiries. This public exigency would not permit delay associated with receiving competitive proposals for this work. Additionally, ABM Janitorial Services - Southwest, Inc., already onsite and familiar with the facility under Contract No. GS-06F-0069N, Order No. GS-P-09-09-KS-0049, was identified as the most expeditious source that could provide these emergency remediation and repair services. 5. Determination that the order represents the best value consistent with 8.404(d): GSA has already determined the prices of supplies and fixed-price services to be fair and reasonable when Schedule Contract was awarded. For this requirement a price evaluation will be conducted to ensure the overall price is fair & reasonable and will be compared to the independent government estimate. The contractor proposed is already very familiar with this type of work. 6. Description of the Market Research conducted among the schedule holders and the results or a statement of the reason market research was not conducted: Market research was not conducted, due to the emergency response necessary by the onsite contractor ABM Janitorial Services - Southwest, Inc. 7. Other Facts Supporting the Use of Other than Full and Open Competition: See item #4. 8.
