- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 6, Network Contracting Office, VA Medical Center, Hampton, Virginia. The 2237 number is 558-13-2-122-0041. 2.Nature and/or Description of the Action Being Processed: This is a "Brand Name Justification" for the procurement of the Arthrex Hip Distractor System for VAMC Durham, NC. 3.Description of Supplies/Services Required to Meet the Agency's Needs: VAMC Durham requires: "1 Hip Distractor System AR-6529S $33,500.00 "1 HDS Stabilizer Leg AR-6529-16 $0.00 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition That Requires the Use of the Authority Cited Above (applicability of authority): This is a Sole Source for "Arthrex" Hip Distractor System. The contractor's unique qualifications are based on "Sources Sought" solicited with salient characteristics through FBO for four calendar days. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A "Sources Sought Notice" was solicited through FedBizOps with no other responses. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: As per FAR 13.106-3 (2) (iii) and (vi), the contractor's price is a 30% cost savings compared to the IGCE and $14,358.00 cost deduction compared to the listed price. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A detailed market research was conducted for this procurement in accordance to FAR Part 10. Internet searches were conducted using key words, "hip distractor" and "hip distraction." A "Sources Sought" was solicited through FedBizOps with no other responses. Due to a contrast in salient characteristics; the Smith & Nephew Hip Positioning System and Mizuhosi Orthopedic Table System were not the best value to the end user's requirements. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: Refer to paragraph 5. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: 1.Arthrex Inc. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Market research will be conducted for subsequent acquisitions to ensure fair and open competition.
