- The U.S. Army Corps of Engineers, Huntsville Engineering and Support Center (CEHNC), intends to issue a sole source acquisition conducted under the authority of FAR Part 12 and FAR 6.302-1. This acquisition will be with Pond Constructors, Inc. The Contractor will provide all labor, supervision, transportation, supplies, vehicles, tools, materials, facilities, equipment, and incidentals necessary to conduct Minor/Emergency repairs and Minor Construction on the Defense Logistics Agency-Energy (DLA-E) capitalized petroleum facilities at the following sites: San Clemente, CA, San Nicholas Island, CA, NAS Fallon, NV, Camp Lejuene, NC (only the GOCO sites at Michael Street, Camp Johnson and Camp Geiger), 29 Palms, CA, MCLB Barstow, CA, MCD Pendleton, CA, Sewell's Point, VA, JBAB Anacostia-Bolling, DC, NAS Guantanamo Bay, Cuba, and AUTEC, Bahamas as described in the Basic Ordering Agreement (BOA) and this Order (see Attachment A). Pond Constructors will provide all labor, supervision, transportation, supplies, vehicles, tools, materials, facilities, equipment, and incidentals necessary to conduct Minor/Emergency repairs and Minor Construction of DLA-Energy capitalized petroleum facilities at the aforementioned installations. Per BOA requirements, emergency repairs have to be responded to within 12 hours and completed within 72 hours after approval. Minor repairs have to be responded to within five days and completed within 15 days after approval. The continuance of this service with Pond Constructors is essential to the DLA-E program mission. This procurement is being conducted as a sole source for the following reasons: a. Unacceptable delays in fulfilling the Government's requirement will occur if a sole-source award is not granted. This would result in mission failure for the various end user agencies. Fifty to sixty-six percent of most emergency repair service orders relate to some type of fuel leak or spill. Therefore, a disruption in service could result in safety hazards as well as loss of life. If emergency repair services were halted, environmental violations would occur due to the hazardous nature of the liquids involved. In addition, fuel facilities that operate out of compliance with Department of Defense, DLA-E, and Navy environmental policies and laws could be subject to fines, legal action, or facility closure. b. Pond Constructors, Inc. performs these services using a unique team of internal resources and ten regionalized subcontractors. In addition, Pond Constructors is already familiar with all service components and procedures at these installations. Pond Constructors is currently present at the required sites. They stand ready to service the sites twenty-four (24) hours a day, seven days per week. c. Pond Constructors, Inc. is uniquely qualified to fulfill pending requirements in the most efficient manner. The proposed work to be performed is directly related to the experience of Pond Constructors' previous task orders. Pond Constructors, Inc. is currently providing the required services under Single Awarded Task Order Contract (SATOC) W912DY-10-D-0018-0020. This task order has limited capacity remaining. Because of the priority that is emphasized on the emergency response services in the sites mentioned, it is imperative that the emergency services continue without delay. A determination by the Government not to compete this proposed Order based on responses to this notice is solely within the discretion of the Government. The period of performance end date is projected to be 15 March 2014. Prior to the period of performance completion date, this requirement will be competed among BOA and non-BOA holders at the discretion of the Contracting Officer in order to ensure future opportunities to other contractors. Responsible firms that may be interested in this synopsis may submit a brief statement of their interest and qualifications. This statement should be no more than 10 pages in length. This is NOT a formal notice of solicitation. Interested firms must provide statements submitted via e-mail no later than 5:00 pm CST on 31 May 2013. All responses should be directed to Gregory Hodgson at Gregory.Hodgson@usace.army.mil. The Government will evaluate the statements and may consider qualified contractors for future orders at the required sites mentioned above.
