- A determination not to compete this proposed contract was made pursuant to the Federal Acquisition Regulation (FAR) 13.106-1(b)(1), Soliciting from a Single Source. For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract deem only one source reasonably available. Rimage Corporation is the manufacturer of Rimage Model 5400N CopyStations. These units are used for evidence offload from recorders to optical media. The units have warranty and support maintenance plans from the manufacturer, which have different warranty end dates as they were purchased at different times. The Federal Bureau of Investigation (FBI) has a requirement for the extension of the maintenance plans for some units, so that all units have the same expiration date. The alignment of the end date is important so the FBI may be confident that all 120 units are uniformly under warranty and maintenance. Additionally, the maintenance plan includes Rapid Exchange, meaning the manufacturer will advance-ship a replacement unit to the device location. This is important as some recording devices cannot be placed back into service until evidence has been offloaded. The Rapid Exchange offers the least amount of downtime to the field for use of their recording assets. As Rimage Corporation is the manufacturer of the Model 5400N Rimage CopyStation units, only Rimage Corporation can provide an extension of the warranty, maintenance, and provide Rapid Exchange service. This procurement is being conducted under Simplified Acquisition Procedures; only one source is reasonably available. The government intends to use FAR Part 12 to purchase the above listed item. The North American Industry Classification System (NAICS) code for this item is 334112 Storage devices, computer, manufacturing. This notice of intent is not a formal solicitation or request for competitive proposals. No solicitation document is available and telephone requests will not be accepted. No award will be made on the basis of quotations or offers received in response to this notice. The government contemplates an award of a fixed price delivery order contract. The intent of this synopsis is for informational purposes only. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement for future requirements. A determination by the government not to compete this action is based on this notice and solely within the discretion of the government.
