Description

SUBJECT: Justification for Acquisition by Means Other than Full and Open Competition under Authority of 10 U.S.C. 2304 (c) (1) of the Federal Acquisition Regulation Title: Justification and Approval (J&A) for Other than Full and Open Competition for items available from only one or a limited number of sources under 10 U.S.C. 2304(c) (1). Summary/Introduction (10 U.S.C. 2304 (c) (1): The Government has a need for continued contract support for th e sole source items supplied under Griswold Industries Indefinite Quantity Contract, SPM760-03-D-9701, which will expire 06 March 2013. This contract action is to make a 180 day sole source award to Griswold Industries under the same terms and conditions of contract SPM760-03-D-9701 and will be executed by modification. Contract SPM760-03-D-9701 is an Indefinite Quantity Contract for code and part numbere d items that are manufactured by Griswold Industries, CAGE 86184 The six-month sole source award has an estimated dollar value of the contract maximum will be. Contract SPM760-03-D-9701 is the Government's only long term arrangement for these items that are sole source to Griswold Industries. Contract SPM760-03-D-9701 consists of a one year base period with nine, one year option periods. The six-month sole source award contains 578 sole source items in support of the Light and Medium Tactical Vehicles (FMTV) that have a corresponding NSN associated with it. The contract terms and conditions of SPM760-03-D-970 1 will remain the same with the six-month sole source award. Contract SPM760-03-D-9701 was awarded following a solicitation by means of other than full and open competition under the authority of 10 U.S. C.. · 2304(c)(1), as indicated in paragraph 6.302-l(a)(2) of the Federal Acquisition Regulation ( FAR ). The SAPD made the decision to proceed with a successor project on November 2011. NIIN data technical scrub was completed in February 2012. The Acquisition Specialist, Tracy Roberts received the successor project on January 2012. Market research was completed on 3/23/12. Solicitation is in review, review required through HCA Nov 2012. Estimated date for synopsis is 3/3/13, estimated date for solicitation issued is 3/18/13. ·This successor project has an estimated award date of June 2014. However Griswold would only agree to a six-month award. It is determined in the best interest of the Government to pursue a six-month sole source award for these 578 NSNs. For the proposed six-month sole source award, Griswold Industries has agreed to use the terms, conditions and pricing of contract SPM760-03-D-9701. In January 2013, a technical review of the AMC/AMSC coding for NSNs under this contract action confirmed that Griswold Industries is the only approved source for the 578 NSNs. An additional review of NSNs with an AMSC code of L and estimated value exceeding $10K necessitated a coding change from L to D for those NSNs. The Small Business Coordination (2579) form has been formally approved by the cognizant Small Business Offices. Description of Agency's Need (10 U.S.C. 2304 (f)(3)(A): DLA Land and Maritime has initiated a successor solicitation however the proposed award date is June 2014 and contract SPM760-03-D-970lexpires 06 March 2013. Griswold Industries has agreed to a six-month sole source award with all terms and conditions remaining the same. Estimated value for the proposed six-month sole source award is and the contract maximum of should be sufficient to cover anticipated obligations. To date obligations paid under Contract SPM760-03-D-970l are $22,971,945.30. Contract SPM760-03-D-9701 had a contract maximum of $84,000,000. Thus, there are sufficient funds to cover anticipated obligations. Authority for Other than Full and Open Competition (10 U.S.C. 2304 (f)(3)(B): The Strategic Acquisition Program Directorate of DLA Land and Maritime is seeking approval for a sole source contract awar d for a period of six months, from 07 March 2013·to 06 September 2013 to Griswold Industries using the terms, conditions, and pricing of the current contract, SPM760-03-D-9701, for administrative convenience. The six-month sole source award will be issued under Other than Full and Open Competition authority for items available from only one source, 10 U.S.C. 2304 (c) (1), as implemented by FAR 6.302-l ( a )(2)( ii )( B ). The current corporate contract has 578 items manufactured by Griswold Industries and the ·Contracting Officer proposes to pursue a six-month sole source award for 578 items with Griswold Industries on the basis that they are the only source for the parts. The unit prices for all items will be the same as the current unit prices for the current performance period, which is the ninth option period. These prices were found fair and reasonable based on negotiations and cost/price analysis. Pursuant to statutory authority lO.U.S.C. 2304(c) (1) and FAR 6.302, other than full and open competition is permitted as these items are available from only one source. The Strategic Acquisition Program Directorate of DLA Land and Maritime has determined that the most efficient way to continue supporting the military customer is to award a six-month (180 days ) sole source award which would expire on 06 September 2013. Price/Cost Considerations (10 U.S.C. 2304(f)(3)(c): As previously indicated, the cost to the Government for the six-month sole source award will be fair and reasonable as the original contract was awarded with the prices offered being found fair and reasonable based upon cost/price analysis. The contract will be utilizing the same unit prices as were established durin g the contract performance period which is the ninth option year period of contract SPM760-03-D-9701. Market Research/Efforts to Obtain Competition (10 U.S.C. 2304(f)(3)(D) and 10 U.S. C. 2304 (f)(3)(E): No formal market research was conducted relating to the six-month sole source award; the basic contract market survey was solely with Griswold Industries. A current technical review by SAPD technicians of the NS N s confirmed that Griswold Industri.es is the only approved source for the 578 NSNs under consideration. Action Being Taken to Overcome Barriers to Competition (10 U.S.C. 2304(f)(3)( F ): A Justification and Approval for Other than Full and Open Competition was completed and DLA Land.and Maritime issued a synopsis of the six-month sole source award in the Federal Business Opportunities ( F edBizOpps) on 17 January 2013 to advise industry of the proposed six-month sole source award and request responses from any interested parties; no response were received. A copy of the original solicitation will be furnished to any vendor expressing interest. A Determinations and Findings memorandum has been prepared that formally address the authority and need to make a six-month sole source award to Griswold Industries.
