Description

SUBJECT: Justification for Acquisition by Means Other than Full and Open Competition under Authority of 10 U.S.C. 2304 (c) (1) of the Federal Acquisition Regulation Title: Justification and Approval (J&A) for Other than Full and Open Competition for items available from only one or a limited number of sources under 10 U.S.C. 2304(c) (1). Summary/Introduction (10 U.S.C. 2304 (c) (1) : The Government has a need for continue d contract support for the sole source items supplied under Rockwell Collins Indefinite Quantity Contract, SP0700-03-D-9730, which will expire May 08, 2013. This contract action is to make a 206 day sole source award to Rockwell Collins under the same terms and conditions of contract SP0700-03-D-9730 and will be executed by modification. Contract SP0700-03-D-9730 is an Indefinite Quantity Contract for code and part numbered items that are manufactured by Rockwell Collins, CAGE 13499. The seven-month sole source award has an estimated dollar value of ; the contract maximum for this period is. Contract SP0700-03-D-9730 is the Government's only long term arrangement for these items that are sole source to Rockwell Collins. Contract SP0700-03-D-9730 consists of a one year base period with nine, one year option periods. The seven-month sole source award contains 42 sole source items in support () fthe Light and Medium Tactical Vehicles (FMTV) that have a corresponding NSN associated with it. The contract terms and conditions of SP0700-03-D-9730 will remain the same with the seven-month sole source award. Contract SP0700-03-D-9730 was awarded following a solicitation by means of other than full and open competition under the authority of 10 U.S.C. 2304(c)(l), as indicated in paragraph 6.302-1(a)(2) of the Federal Acquisition Regulation ( FAR ). The Supplier Relationship Manager (SRM) Donna Ramsey, initiated discussions with Rockwell Collins in Jan 2012. On October 14,2010 DLA Land and Maritime and DLA Land Aberdeen began work to include the consumable items on a project that DLA Land Aberdeen was working. When the project reached the Integrated Acquisition Review Board, Milestone A, on August 8, 2011, DLA land and Maritime Legal Counsel took exception to the inclusion of these consumable items in this project, see attached findings. Based on these findings, the leadership in Maritime Supplier Operations made the decision to proceed as quickly as possible with a separate project for the consumable items. This successor project has an estimated award date of October 2013. The contract modification for this seven-month sole source award will ensure that, all terms and conditions of the basic contract would apply to the additional time period. It is determined in the best interest of the Govermnent to pursue a seven-month. If!!. Federal Recycling.Program,.Printed on Recycled Paper sole source award for these 42 NSNs. For the proposed seven-month sole source award, Rockwell Collins has agreed to use the terms, conditions and pricing of contract SP0700-03-D- 9730. I n April2013, a technical review of the AMC/AMSC coding for NSNs under this contract action confirmed that Rockwell Collins is the only approved source for the 42 NSNs. An additional review ofNS N s with an AMSC code of L and estimated value exceeding $ 1 OK necessitated a coding change from L to D for those NSNs. Also, technical review confirmed that DSCC does not/cannot get the technical data for these items and items coded H are coded correctly. The Small Business Coordination (2579) form has been formally approved by the cognizant Small Business Offices. Description of Agency's Need (10 U.S.C. 2304 (Q(3)(A): DLA Land and Maritime has initiated a successor solicitation however the proposed award date is October 2013. Rockwell has agreed to a seven-month sole source award that would end on November 30, 2013. If the successor contract is awarded before November 30, 2013, the seven-month sole source award will end on the award date of the successor contract. Rockwell Collins has agreed to a seven­ month sole source award with all terms and conditions remaining the same. Estimated value for the proposed seven-month sole source award is and the contract maximum of should be sufficient to cover anticipated obligations. To date obligations paid under Contract SP0700-03-D-9730 are $6,549,646.00 Contract SP0700-03-D-9730 had a contract maximum of$15,052,151.00. Thus, there are sufficient funds to cover anticipated obligations. Authority for Other than Full and Open Competition (10 U.S.C. 2304 (f)(3)(B): The Strategic Acquisition Program Directorate ofDLA Land and Maritime is seeking approval for a sole source contract award for a period of seven months, from May 08, 2013 to November 30, 2013 to Rockwell Collins using the terms, conditions, and pricing of the current contract,. SP0700-03-D-9730, for administrative convenience. The seven-month sole source award will be issued under Other than Full and Open Competition authority for items available from only one source, 10 U.S.C. 2304 (c) (1), as implemented by FAR 6.302-1( a )(2)( ii )( B ). The current corporate contract has 634 NSNs manufactured by Rockwell Collins and the Contracting Officer proposes to pursue a seven-month sole source award for 42 items with Rockwell Collins on the basis that they are the only source for the parts. The unit prices for all items will be the same as the current unit prices for the current performance period, which is the ninth option period. These prices were found fair and reasonable based on negotiations and cost/price analysis. Pursuant to statutory authority 10.U.S.C. 2304(c) (1) and FAR 6.302, other than full and open competition is permitted as these items are available from only one source. The Strategic Acquisition Program Directorate ofDLA Land and Maritime has determined that the most efficient way to continue supporting the military customer is to award a seven-month (206 days ) sole source award which would expire on November 30, 2013. - Federal Recycling Program " P - r ' inte d on Recycled Paper ( Price/Cost Considerations (10 U.S.C. 2304(f)(3)(c): As previously indicated, the cost to the Government for the seven-month sole source award will be fair and rea.sonable as the original contract was awarded with the prices offered being found fair and reasonable based upon cost/price analysis. The contract will be utilizing the same unit prices as were established during the contract performance period which is the ninth option year period of contract SP0700-03-D-9730. Market ResearcbJEfforts to Obtain Competition (10 U.S.C. 2304(f)(3)(D) and 10 U.S.C. 2304 (f)(3)(E): No formal market research was conducted relating to the seven-month sole source award; the basic contract market survey was solely with Rockwell Collins. A current technical review by SAPD technicians of the NSNs confirmed that Rockwell Collins is the only approved source for the 42 NSNs under consideration. Action Being Taken to Overcome Barriers to Competition (10 U.S.C. 2304(f)(3)(F): A Justification and Approval for Other than Full and Open Competition was completed and DL A Land and Maritime issued a synopsis of the seven-month sole source award in the Federal Business Opportunities ( F edBizOpps) on March 19, 2013 to advise industry of the proposed seven-month sole source award and request responses from any interested parties; no responses were received. A copy of the original solicitation will be furnished to any vendor expressing interest. A Determinations and Findings memorandum has been prepared that formally address the authority and need to make a seven-month sole source award to Rockwell Collins.
