- Statement of Work for CMS Master Labor Agreement Requirement NOTICE OF INTENT TO AWARD SOLE SOURCE INTENT TO AWARD SOLE SOURCE: The Centers for Medicare and Medicaid Services (CMS) intends to award on a sole source basis, under the Simplified Acquisition Procedure (dollar threshold of $150,000), for expert services from Joseph Swerdzewski and Associates, 6585 HWY 431 South, Suite E457, Hampton Cove, AL 35763-9230. Under the authority of FAR 6.301-1 10 U.S.C. 2304 only one responsible source and no other supplies or services will satisfy agency requirement. The purpose of this request is to obtain research, analysis and consultative services in pursuit of a new Master Labor Agreement (MLA) to include advice and guidance on Executive Order 13522 which requires the establishment of a cooperative and productive form of labor management relations within CMS. CMS REQUIREMENTS: The current MLA between the Centers for Medicare & Medicaid Services (CMS) and the American Federation of Government Employees, Local 1923 (AFGE or the Union), expires this year and in anticipation of its expiration, CMS must begin preparing for negotiations. The agency is in need of expert assistance for research, analysis and consultative services regarding all aspects of implementation and post implementation (including litigation) of a new MLA, and the establishment of a cooperative form of labor management relations within CMS. Specialized experience in federal sector labor relations or direct specialized experience working with Federal Labor Relations Authority (FLRA) case law is critical to fulfilling the agencies needs for research, analysis and consultative services in pursuit of a new MLA. There is only one potential contractor who currently available and possesses the necessary expertise and experience to provide the specific consultative services deemed necessary by the Agency to ensure a successful and timely implementation of a new MLA for the agency. Mr. Swerdzewski, served as the General Counsel for the FLRA for two terms. He has over 20 years working in the FLRA, an agency that oversees and sets the standard for federal labor relations. He has worked both sides in the authority as a staff attorney dealing directly with agencies, and he has been in charge of the FLRA. In the Federal labor relations community, he is well known for his advice and policy memorandums on labor relations topics for the federal sector, which he issued, while General Counsel. The inside knowledge and experience that Mr. Swerdzewski has gained while working for the FLRA has equipped him with specialized experience in federal labor relations theories, principles and practices, problems precedents, regulations, and concepts pertaining to Federal labor relations. For CMS's upcoming negotiations and involvement in establishing a labor management forum within CMS, this specialized experience is needed to ensure that the agency negotiates the best contract possible and in the most efficient manner. INTERESTED PARTIES: All responsible sources may submit capability statement, which shall be considered by the agency. In order to qualify as a potential contractor for this procurement, the contractor must possess the knowledge and the experience needed to negotiate a Union management labor agreement in a federal environment. In addition the contractor needs to make sure that it meets the criteria of Executive Order 13522. DISCLAIMER: This notice is not a Request for Proposals or a Solicitation, nor does it restrict the Government as to the ultimate acquisition approach. This notice is not a commitment from the Government. The Government will not reimburse any bid or proposal costs as a result of this notice. No solicitation will be disregarded. However, any future solicitation that will be open to competition will be subsequently issued on FedBizOpps in order to permit firms to respond.
