- JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity. Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD 2. Description of the Action Being Approved. This Justification and Approval authorizes and approves on a sole source basis the authority to exercise 52.217-8 Option to Extend Services (Nov 1999) for continuation of services for Booz Allan Hamilton, Inc (BAH) of McLean, Virginia, under contract N00421-12-C-0001. The Period of Performance for this extension will begin 1 June 2013 and end on 31 July 2013. This will provide an additional level of effort of 13,137 hours for a Cost Plus Fixed Fee CLIN and Cost reimbursable CLINS, for a period of two months. The additional level of effort will allow for the continuity of critical engineering and program management services required to support the Identification Systems Division (IDS), 4.5.9. NAWCAD, St. Inigoes, MD, until the pending, fully competitive three year Seaport-e contract, estimated award June 2013, assigned to Patuxent River is completed. 3. Description of Supplies/Services. The purpose of this option to extend services is to provide two (2) additional months of support including a (1) month transition. IDS requires these services to support the Fleet with the ability to positively identify and track cooperative and non-cooperative targets in both combat and air traffic control environments. IDS provides support for the Navy, Air Force, Coast Guard, and other customers. Contract N00421-12-C-0001 was non-competitively awarded to BAH to provide these services with an expiration date of 31 January 2013. 52.217-8 Option to Extend Services (Nov 1999) was invoked with a period of performance of 1 February 2013 through 31 May 2013. The additional two month extension is necessary to allow sufficient time to process a competitive procurement while providing uninterrupted engineering and program management services to the IDS Division. The approximate value of this extension is $1,355,771.34 and will be funded with FY13 dollars. The approximate value of the 6 month option to extend services period in its entirety is $3.1 M (J&A 13-23172 was approved on 31 January 2013 to authorize the previous 4 months of the option to extend services period. NAWCAD, Patuxent River, MD is currently processing the follow-on contract as a full and open Seaport-E competition and anticipates award by 30 June 2013. The period of performance for this two-month extension including a one month transition, if required, will be from 01 June 2013 through 31 July 2013. It is crucial that this extension be awarded by 01 June 2013 to prevent a lapse in current support until the competitive follow-on contract can be awarded. See Appendix A for Estimated Dollar Value 4. Statutory Authority Permitting Other Than Full and Open Competition. 10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements. 5. Rationale Justifying Use of Cited Statutory Authority. NAVAIR competitively awarded a contract for IDS program support services to BAH under contract N00421-06-C-0002 and non-competitively awarded contract N00421-12-C-0001 to BAH for continuation of those services. As the incumbent, BAH is the only source capable of providing the necessary continuation of these services without causing a break in support. Failure to extend the existing bridge contract for two months would result in a break in service which would be detrimental to the support of multiple programs. It is impossible for another contractor to assume the ongoing workload without a transition period which would cause unacceptable delays in completing or continuing tasks under multiple programs for the Navy, Air Force, Coast Guard, and other IDS customers. NAWCAD 4.5.9 provides worldwide in-service engineering efforts for multiple programs to maintain a critical shipboard system operational, for US Navy & US Coast Guard ships. IDS is the only DOD activity that supports these systems. BAH is the only company capable of supplying the short-term support within the available time frame and will provide continued seamless performance. BAH has the available resources in place and is ready to continue program execution through 31 July 2013. The proposed extension is in the Navy's best interest as it is a logical continuation of the current requirement and will provide the time required for the Navy to award the follow-on contract on a competitive best value basis. 6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable. A synopsis of this proposed sole source modification was posted in FedBizOps on 29 April 2013 and closed 13 May 2013. No capability statements or responses were received for this extension. However, market research was conducted for the follow-on effort and it was determined there are multiple vendors capable of providing the required services and they will have utilized the opportunity to compete for the follow-on contract under a full and open basis. Awarding this limited-time extension to allow a complete and vigorous competition is in the best interest of both the Navy and industry and promotes the maximum fair competition opportunity for the long-term contract. 7. Determination of Fair and Reasonable Cost. Contract N00421-12-C-0001 is in the option year II of a one year two month bridge with a period of performance of 1 Oct 2012 through 31 January 2013. In accordance with FAR 52.217.8 Option to extend Services can be utilized for up to a six month period. A four month extension was issued using J & A 13-23172 for a period of performance of 1 February 2013 through 31 May 2013. At this time the period of performance is being extended for an additional two months with a period of performance of 1 June 2013 through 31 July 2013. In accordance to FAR 15.402, the Contracting Officer will ensure that all supplies and services provided under contract N00421-12-C-0001 are procured at a fair and reasonable price. The increase in ceiling for each additional CLIN was established by dividing the total amount of dollars of each CLIN divided by four (4) (CLIN was originally four months) to establish monthly average. The monthly average is multiplied times two (2) (CLIN to establish the CLIN amounts for two (2) months). All SCA labor categories are in accordance with the most current rates provided by the Department of Labor dated 13 June 2012. The Contracting Officer performed price analysis and utilized necessary resources to help determine a fair and reasonable price. 8. Actions to Remove Barriers to Future Competition. This action is for an extension of the contract Period of Performance, while a competitive follow-on procurement is awarded. Solicitation # N00024-12-R-3084 is in the evaluation process for a competitive Small Business Set Aside contract award in Seaport-e which is expected to be awarded in June 2013.
