Description
DEPARTMENT OF VETERANS AFFAIRS JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1.Department of Veterans Affairs, VISN 8, VA Caribbean Healthcare Systems, 10 Calle Casia, San Juan Puerto Rico. 2.The VA has the requirement to provide third party asbestos monitoring and inspection services in VA Caribbean Healthcare System (VACHS), San Juan, PR, at the Breezeway/Loading dock upgrade Project. 3.Environmental Health & Services, Inc. (EH&S) will perform the necessary monitoring, inspection, testing and other support services to ensure that VA patients, employees, and visitors will not be adversely affected by the abatement work, and that the abatement work proceeds in accordance with asbestos abatement VA specifications, as per the contract. 4.This requirement is being procured in accordance with FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. 5.Only one responsible source can meet mission needs (FAR 6.302-1). The on-site analysis of PCM air samples collected outside the regulated area is required during asbestos abatement projects in order to ensure that the project area, VA patients, employees, and visitors will not be adversely affected by the abatement work. On-site/field analysis of PCM air samples can only be conducted by Asbestos Analyst Registry (ARR) board approved analysts that belong to an ARR approved organization. EH&SS is the only ARR approved organization in Puerto Rico with ARR board approved analysts. 6.The VA issued a Notice of Intent to sole-source this procurement on Fed Biz Ops (FBO). EH&S is the only ARR approved organization in Puerto Rico with ARR board approved analysts. 7.The Contracting Officer performed price analysis on EH&S's proposal and compared the price with that of the Government Estimate. The Government Estimate was developed using current industry standards. Negotiations took place which resulted in a determination of price as being fair and reasonable for this project. 8.As described in No. 6 above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties. 9.The procurement of providing third party asbestos monitoring and inspection services is needed to meet the growing and expanding needs of the medical center, as the veteran population on the island of Puerto Rico has experienced significant growth. 10.In response to the FBO notice posted, the following companies that have expressed an interested in this project: Marvin Heymann & Associates 11.Although these services are only performed by EH&SS, market research will continue to ensure other companies are considered in the future if available. 12.I certify that the requirement outlined in this Justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
