Description

The Network 11 Contracting Office (NCO 11) hereby gives notice of intent to award a sole source Interim contract to First Community Care, LLC, 60 Northpointe Parkway, Amherst, NY 14228 to continue to provide Home Oxygen Services to VISN 11 facilities in located Battle Creek, MI, Saginaw, MI and Danville, IL. NCO 11 intends to negotiate with only one source under authority of FAR 6.302-1; only one responsible source and no other supplies or services will satisfy agency requirements. First Community Care, LLC is the incumbent and the only practicable, responsible source to provide continuity of services. Services are required immediately while the protest for the long-term Home 02 contract (VA251-11-RP-0080) is being resolved and the new long-term contract is completed. A previous solicitation (VA251-11RP-0080) from VISN 11 for Saginaw and Battle Creek, MI and Danville, IL has been protested in the Federal Court of Claims (Civil Action Number 12-114C), and a stay is currently in place until the protest is resolved. A sole source interim contract needs to be created utilizing the existing contractor to eliminate a break in service until the protest has been resolved. If a new contractor was to transition services for this interim contract, all equipment would need to be picked up by the existing contractor, and a re-issuance of equipment would need to occur with the new contractor. Once the long term Home 02 contract was awarded several months later, this process would take place again, which would cause extreme hardships, stress, and a break in service to our Veterans. Please do not request a copy of a solicitation. This notice is neither a request for competitive proposals, nor is it a solicitation of offers. Any response to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government and any capability statement provided must address services listed above. Written communication received will be considered solely for the purpose of determining whether to conduct a competitive procurement. If no affirmative written response is received on or before June 10, 2013, the contract will be awarded without further notice. No telephone inquiries will be accepted. Inquiries will only be accepted via email at connie.mckay@va.gov. A determination by the Government to not compete this requirement based on responses to this notice is solely within the discretion of the Government. THIS SYNOPSIS DOES NOT COMMIT THE GOVERNMENT TO CONTRACT FOR ANY SUPPLY OR SERVICE. THE GOVERNMENT WILL NOT PAY FOR ANY INFORMATION OR ADMINISTRATIVE COSTS INCURRED IN RESPONSE TO THIS SYNOPSIS.
