Bids are being solicited under solicitation number VA247-13-Q-0824_02. This announcement constitutes the only solicitation; bids are being requested and a written solicitation will not be issued. The solicitation is issued as an invitation for bids (IFB), unless otherwise indicated herein.If your company can provide the product/services listed on the solicitation and comply with all of the solicitation instructions, please respond to this notice. GSA Schedule Bids Only: Sellers bidding on this opportunity MUST have the items requested on an existing GSA Schedule. The Schedule must either be in the Seller's name or the Seller must be able to document its ability to act as an agent of a partner's Schedule. Sellers must not bid more than their applicable contract ceiling price, excluding the FedBid Fee, for contract-specific items. If FedBid receives notice that, due to inclusion of the FedBid Fee, the Selected Bid's line item pricing is higher than the Selected Seller's applicable published government contract pricing, the FedBid Fee will be reduced to ensure the Selected Bid's line item pricing does not exceed the Selected Seller's applicable contract pricing. This requirement is a [ Small Business ] set-aside and only qualified sellers may submit bids.The solicitation pricing on www.FedBid.com will start on the date this solicitation is posted and will end on 2013-06-04 16:00:00.0 Eastern Time or as otherwise displayed at www.FedBid.com.FOB Destination shall be DUBLIN, GA 31021 The VHA NCO 07 - 557 - Dublin, GA requires the following items, Meet or Exceed, to the following: LI 001: CARGO SHIPPING CONTAINERS DIMENSION: 40'L x 8'W x 8'H MADE OF CORTEN RUST RESISTANT STEEL, ONE 8' ROLL-UP SIDE DOOR IN MIDDLE, 4' SWING DOORS ON BOTH ENDS (TOTAL TWO), DOORS TO HAVE LOCK BARS, MUST BE ISO (SEA WORTHY) PRIOR TO DOOR INSTALL COLOR: GRAY NO FORK POCKETS INCLUDE DELIVERY AND PLACEMENT IN PRICE, 2, EA; Solicitation and Buy Attachments ***Question Submission: Interested offerors must submit any questions concerning the solicitation at the earliest time possible to enable the Buyer to respond. Questions must be submitted by using the 'Submit a Question' feature at www.fedbid.com. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** For this solicitation, VHA NCO 07 - 557 - Dublin, GA intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. A Seller may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. VHA NCO 07 - 557 - Dublin, GA is taking this action in an effort to improve both seller access and awareness of requests and the agency's ability to gather multiple, completed, real-time bids.All responsible Sellers that respond to this solicitation MUST submit the pricing portion of their bid using the online exchange located at www.FedBid.com. There is no cost to register, review procurement data or make a bid on www.FedBid.com.Sellers that are not currently registered to use www.FedBid.com should proceed to www.FedBid.com to complete their free registration. Sellers may not artificially manipulate the price of a transaction on www.FedBid.com by any means. Pursuant to the Trade Agreements Act (19 U.S.C. 2512(a)) (TAA), Federal acquisitions of supplies may be made only from offerors that will supply products of an eligible country under any of the free trade agreements entered into pursuant to the TAA. An article is considered a product of a country only if it is wholly a product of that country or if it has been substantially transformed in that country into a new and different article of commerce with a name, character, or use distinct from that of the original article(s). Note that any item that is a discreet article as it is sold in commerce, regardless of its ultimate function or use, cannot be considered substantially transformed? based solely on its integration into IT or other systems. In addition to any VHA buy terms entered in FedBid, the Seller (Bidder) has reviewed and acknowledges any attached solicitation documents, item details, delivery schedule, and/or instructions to Seller (collectively referred to as requirements), and agrees to all terms and conditions set forth in the solicitation documents. While additional support documentation (e.g. Seller Attachments) may be requested, pricing shall be entered as a 'bid' in the reverse auction - offline pricing is not an acceptable bid. At the conclusion of the reverse auction, if attached to the buy, the apparent winning bidder shall be required to complete the solicitation documents prior to award. New Equipment ONLY; NO remanufactured or "gray market" items. All items must be covered by the manufacturer's warranty. QUESTIONS FROM AN INTERESTED SELLER: I understand that you want two (2) 40' ISO containers that have the standard shipping doors on either end that is certified as sea worthy, then you want it modified to have an 8' roll up door in the middle of the long wall on one side. Is that correct? YES Also, most containers have the pockets for the forklift will that be a problem if they are already there? NO I understand that you want delivery and placement. How will you expect these units to be placed? We could ship them on a roll of bed, but if you have items that will not make that possible then a crane will be needed to offload the truck. Either way if fine, we just need notification of the proposed method of shipment. So we have proper offload equipment (Crane). COMMENT FROM AN INTERESTED SELLER : Well, as I have explained a 1000 times over, 99% OF ALL ISO CONTAINERS ARE MADE IN CHINA which is not a qualifying country. I could respond in 60 seconds to the requirement but it would not meet the stated requirements. Anyone responding is either going to have to charge 300% more than normal retail for boxes from the two locations in the US that buy Chinese kits and then assemble in the US??? OR The containers are not regular standard ISO certified shipping containers OR They are swapping out the plates and defrauding the Govt. which is something I simply will not do. I have explained this to the Govt. for the last 30 years and yet it doesn?t sink in??I wish it would. Please note our new contact information below. Response: Thanks for the Information. As prescribed in 25.1101(a)(1), insert the following clause: Buy American Act?Supplies (Feb 2009) (a) Definitions. As used in this clause? ?Commercially available off-the-shelf (COTS) item?? (1) Means any item of supply (including construction material) that is? i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101); (ii) Sold in substantial quantities in the commercial marketplace; and (iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and(2) Does not include bulk cargo, as defined in section 3 of the Shipping Act of 1984 ( 46 U.S.C. App. 1702), such as agricultural products and petroleum products. 'Component? means an article, material, or supply incorporated directly into an end product. ?Cost of components? means? (3) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the end product (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or (4) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the end product. Domestic end product? means? (1) An unmanufactured end product mined or produced in the United States; (2) An end product manufactured in the United States, if? (i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind as those that the agency determines are not mined, produced, or manufactured in sufficient and reasonably available commercial quantities of a satisfactory quality are treated as domestic. Scrap generated, collected, and prepared for processing in the United States is considered domestic; or (ii) The end product is a COTS item. ?End product? means those articles, materials, and supplies to be acquired under the contract for public use. ?Foreign end product? means an end product other than a domestic end product. ?United States? means the 50 States, the District of Columbia, and outlying areas. (b) The Buy American Act (41 U.S.C. 10a - 10d) provides a preference for domestic end products for supplies acquired for use in the United States. In accordance with 41 U.S.C. 431, the component test of the Buy American Act is waived for an end product that is a COTS item (See 12.505(a)(1)). (c) Offerors may obtain from the Contracting Officer a list of foreign articles that the Contracting Officer will treat as domestic for this contract. (d) The Contractor shall deliver only domestic end products except to the extent that it specified delivery of foreign end products in the provision of the solicitation entitled ?Buy American Act Certificate.? (End of clause) Must be listed and documented.
