- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR Subpart 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows: 1. Agency and Contracting Activity - Dept. of Homeland Security, U.S. Coast Guard/CEU Providence. 2. Nature and/or Description of the Action being Approved: Approval for a sole source follow-on procurement for real estate services. The Coast Guard has a requirement on a sole source basis to update a subdivision plan and application for properties in Stratford, CT to include a town required conservation easement at an estimated cost of $4708.00 to Godfrey Hoffman Associates of North Haven, CT. The original contract was competitively awarded under HSCGG1-12-P-PRV030 January 4, 2012 in the amount of $12,600.00. 3. Description of Supplies/Services - The contractor is required to add specific Conservation Easement language to the site plan and the subdivision plan. The contractor will also be required to be present at the public hearing and to be available to answer questions about the property survey. In addition the contractor will submit the finished plans to the town and file for the subdivision, with a target date of May 28, 2013, and an alternate submission date of no later than June 25, 2013. The estimated cost for this second submission based on the later date of June 25, 2013 is $4,708.00. 4. Identification of Statutory Authority Permitting Other than Full & Open Competition - The statutory authority permitting other than full and open competition is 10 USC 2304 (c)(1) implemented by FAR Subpart 6.302-1 entitled "Only one responsible source and no other supplies or services will satisfy agency requirements." 5. Demonstration that the Nature of the Acquisition Requires Use of the Authority cited - To contract with any firm other than Godfrey Hoffman to generate the second submission to the Town presents an insurmountable issue as surveyors will not present a plan at a public hearing based on another firm's research. In addition, keeping with the original firm for the revised submission will not require a new plan, drawings, or site survey to be conducted. Contracting with the firm who performed the first survey and subdivision research will avoid critical loss of time and duplication of cost. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. A FedBizOps notice was not publicized. Exception FAR 5.202 (a)(13)(i) applies as the proposed contract action is for an amount not expected to exceed the simplified acquisition threshold. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable - The solicitation for the initial plan and application was issued as a competitive Request for Quotation and was awarded under contract number HSCGG1-12-P-PRV030 on January 4, 2012 in the amount of $12,600.00. The contracted price was determined fair and reasonable based upon a comparison with the Independent Government Estimate in accordance with FAR 15.404-1(b)(2)(v). 8. Description of Market Research - No market research conducted. Sole source follow-on procurement. Alternate sources cannot legally present a plan at a public hearing based on another firm's research. 9. Any other facts supporting the Use of Other than Full & Open competition. n/a. 10. A Listing of the Sources, if any, that Expressed in Writing, an Interest in the Acquisition - n/a 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition Before any Subsequent Acquisition for Supplies or Services Required - n/a. 12. This justification is accurate and complete to the best of my knowledge and belief.
