- INTRODUCTION This is a pre-solicitation / notice of intent synopsis for a sole source noncompetitive (including brand-name) award to Coherent, Inc for maintenance services. The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA) on behalf of the National Institute for Biomedical Imaging and Bioengineering (NIBIB), intends award a fixed price purchase order on a sole source noncompetitive basis for a Maintenance Agreement for the Chameleon Vision II Laser System to Coherent, Inc., 5100 Patrick Henry Drive, Santa Clara, CA 95054. BACKGROUND In order to maintain collaborators with other labs and ensure that research can continue uninterrupted, it is essential to ensure that the equipment is maintained to optimal performance. In the event of a breakdown, it is imperative that service technicians arrive quickly to resolve the issues. Any required service to the Chameleon II Laser System, a laser system with a Titanium sapphire laser used on a microscope in the Biophotonics Section of NIBIB, is important to keep the lab running efficiently. It is used in a technique referred to as PALM-3D, which allows the visualization of proteins at super-resolution precisions within an entire cell. The technique relies on photoactivating (turning their fluorescence "on") in thin serial sections. The laser has been designed to be used in a technique known as two-photon excitation, which is key to the thin section photoactivation. Without this specialized laser, conventional lasers will photoactivated the molecules throughout the cell during image acquisition at one axial position and will thus not allow reconstruction of the entire cell fluorescence. Within the Biophotonics Laboratory, there are four lab members, one Special Volunteer, two intramural collaborators, and five external collaborators that depend on this instrument to perform these types of experiments. PERIOD OF PERFORMANCE The period of performance for this order will be from July 8, 2013 through July 7, 2014, with up to three twelve month option periods. PROJECT DESCRIPTION The contractor shall: 1.Provide all replacement parts, labor, and travel to service the Chameleon Vision II Laser System. It is understood that this is on condition that the user not modify the instrument. 2.Ship the replacement part within 2 days 3.Provide unlimited on-site emergency service in case of failure of the Chameleon Vision II Laser System JUSTIFICATION The sole-single source (including brand-name) justification is as follows: Per the terms and conditions of the Service Agreement from Coherent, should a 3rd party vendor service the Coherent equipment while under a Coherent Service Agreement, the Coherent service agreement will be void. Therefore, should NIBIB obtain the services of the 3rd party vendor for this equipment, any previous agreement with Coherent will be void and a new agreement will need to be established causing delays as well as duplication of costs and work. REGULATORY AUTHORITY This acquisition is conducted under the authority of 41 U.S.C. 253(c) as set forth in FAR Part 13.106-1 (b) (1), Soliciting from a single source not exceeding the simplified acquisition threshold, and is exempt from the requirements of FAR Part 6, Competition Requirements. ADDITIONAL INFORMATION The North American Industry Classification Code (NAICS) is 811219 and the Size Standard is $19 Million. The determination by the Government to award a purchase order on a sole source noncompetitive basis for Maintenance Services to Coherent, Inc., 5100 Patrick Henry Drive, Santa Clara, CA 95054., is based upon the market research conducted in accordance with one or more of the techniques specified in FAR Part 10-Market Research, Subpart 10.002(b)(2). All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency, in writing, no later than June 21, 2013 at 4:00 pm EST. Responses to this notice shall contain sufficient documentation to establish the interested parties' bona-fide capabilities for fulfilling the requirement. All responses must reference this pre-solicitation / notice of Intent number NHLBI-CSB-(EB)-2013-171-JES and may be submitted electronically to Jennifer Swift, Contract Specialist at Jennifer.Swift@nih.gov.
