Description
INTRODUCTION This is a pre-solicitation / notice of intent synopsis for a sole source noncompetitive (including brand-name) award to Hitachi High Technologies America, Inc. (HTA) for maintenance services. The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA) on behalf of the National Institute for Biomedical Imaging and Bioengineering (NIBIB), intends award a fixed price purchase order on a sole source noncompetitive basis for a Maintenance Agreement for Hitachi S-4800 Scanning Electron Microscope to HTA, 3175 N. 28th Avenue, Dallas, TX 75261-2208. BACKGROUND Researchers across the NIH are using the Hitachi S4800 scanning electron microscope (SEM) situated in NIBIB's BEPS Shared Resource to study the structures of biological surfaces. The research includes determining the structure of cell membranes, cell receptors, surface proteins, as well as extracellular matrix. The instrument also provides information about nanostructures and nano-devices that are used in biomedical research. It is essential for the sophisticated S4800 SEM to be maintained at a high level of performance by expert engineers. PERIOD OF PERFORMANCE The period of performance for this order will be from July 8, 2013 through July 7, 2014, with up to three twelve month option periods. PROJECT DESCRIPTION The contractor shall provie the following: 1.All spare parts and components needed to service the Hitachi S-4800 scanning electron microscope. It is understood that this is on condition that the user not modify the instrument. 2.Unlimited on-site emergency service in case of failure of the Hitachi S-4800 scanning electron microscope. Response time will be within 48 hours of request. 3.One preventive maintenance service visit will be included. The service includes cleaning, replacement of vacuum oils, seals, filters, hoses, air and water lines, adjustment of systems, and alignment of columns. 4.All parts and labor are included. JUSTIFICATION The sole-single source (including brand-name) justification is as follows: Per HTA's terms of their service agreement, "All Equipment to be covered under this Agreement must be in a condition ready for ordinary use as determined by HTA prior to the beginning of coverage under this Agreement. Equipment that is currently covered by another HTA service agreement or a new equipment factory warranty shall be deemed to be in such condition. Equipment that has not been covered by another HTA service agreement or new equipment factory warranty for a period of thirty (30) days or longer must pass a pre-service contract inspection by HTA charged at HTA's then current standard billable rates. This pre-service contract inspection shall be effective for thirty (30) days from the completion date of that inspection, and in order for the Equipment to be eligible for coverage, this Agreement must be executed during such thirty (30) day period. Therefore, should NIBIB obtain the services of a 3rd party vendor for maintenance of the Hitachi S-4800 Scanning Electron Microscope, this equipment would need to be inspected prior to HTA agreeing to service/repair the equipment, which would cause an additional expense for the inspection and any potential repairs as a result to bring it up to the HTA standards. REGULATORY AUTHORITY This acquisition is conducted under the authority of 41 U.S.C. 253(c) as set forth in FAR Part 13.106-1 (b) (1), Soliciting from a single source not exceeding the simplified acquisition threshold, and is exempt from the requirements of FAR Part 6, Competition Requirements. ADDITIONAL INFORMATION The North American Industry Classification Code (NAICS) is 811219 and the Size Standard is $19 Million. The determination by the Government to award a purchase order on a sole source noncompetitive basis for Maintenance Services to HTA, 3175 N. 28th Avenue, Dallas, TX 75261-2208, is based upon the market research conducted in accordance with one or more of the techniques specified in FAR Part 10-Market Research, Subpart 10.002(b)(2). All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency, in writing, no later than June 21, 2013 at 4:00 pm EST. Responses to this notice shall contain sufficient documentation to establish the interested parties' bona-fide capabilities for fulfilling the requirement. All responses must reference this pre-solicitation / notice of Intent number NHLBI-CSB-(EB)-2013-170-JES and may be submitted electronically to Jennifer Swift, Contract Specialist at Jennifer.Swift@nih.gov.
