Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ACTIVITY: Department of the Air Force, 1st Special Operation Contracting Squadron/LGCC, Hurlburt Field, FL 32544, PR #F2F1033122A001. II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED This action will be awarded as a brand name, lowest price technically acceptable, firm fixed price purchase order. The brand name notice will be posted to Federal Business Opportunities (FBO) in accordance with Federal Acquisition Regulation guidelines. III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS The C-145A community has a requirement for lightweight, in-ear headsets. This headset must be compatible with both the new AFSOC-approved helmet and the C-145A aircraft. Estimated Cost is $29,700.00. The estimated delivery date is 30 days from contract award. The type of appropriation used is Operations and Maintenance fund code 0100. IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION Authority for this brand name requirement is conducted through 10 U.S.C. 2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirements as implemented by FAR 13.106-1(b)(i). V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) Clarity Aloft Technologies is the only manufacture of a headset that is compatible with both the new helmet and the C-145A aircraft. The new AFSOC-approved helmet requires a specific headset and Clarity Aloft Technologies is the only manufacturer that can provide this. The C-145A aircraft also requires a specific type of plug from the headset into the aircraft. Without the Clarity Aloft Brand headset, C-145A aircrew will be unable to use the new helmet. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE A sources sought notice will be posted to the Federal Business Opportunities (FBO) website. Any challenges to this brand name requirement will be brought to the attention of the Competition Advocate prior to contract award. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE The contracting officer will utilize techniques recommended in FAR 13.106-3(a)(2) to determine the price fair and reasonable. Comparison of past Government acquisitions for the same items will also be used for determining the price fair and reasonable. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED After testing, only two headsets were compatible with the new AFSOC-approved helmet. However, the Clarity Aloft Brand headset is the only option in production. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION N/A X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION (1) Aloft Technologies XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED Through every available means, 6 SOS will continue to monitor market information and technical publications to determine whether any other source can meet our needs. In addition, minimum requirements for any future requirements as described herein will be shared with industry to encourage other manufacturers to begin producing similar compatible products. XII. Contracting Officer's Certification The contracting officer's signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief. XIII. Technical/Requirements Personnel's Certification As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete.
