- NAMA-13-Q-0048 Amendment 002 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Items as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a “Brand Name” fixed price quotation is requested and a written solicitation will not be issued. The solicitation number is NAMA-13-Q-0048 and is issued as a request for quotation (RFQ); quotations furnished are not offers. This request does not commit the Government to pay any costs incurred in the preparation or the submission of this quotation or to contract for supplies or services. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-66 effective April 1, 2013. This is a “Brand Name” requirement in accordance with FAR 11.105 for “items peculiar to one manufacturer” under NAICS 511210, Software Publishers. The resulting purchase order will be a firm-fixed price purchase order and will be issued to the Contractor whose conforming quotation in response to the RFQ will be most advantageous to the Government. BACKGROUND: The National Archives and Records Administration (NARA) has a requirement for the continuance of its Microsoft Enterprise License Agreement to include Software Assurance, Premier Support Services, Subscriptions, Risk Assessment Programs, and True-Up. REQUIREMENTS: The requirements are outlined in Enclosure 1 and Enclosure 2. All delivery costs must be included in the total firm-fixed price quote. NARA requires that all products be purchased from “ Original Equipment Manufacturer ( OEM ) Authorized/Certified Contractors Only ”. Proof of authorization and software support from the OEM including verification that all OEM products are certified authentic must be in the form of a letter signed by an authorized OEM official and must be included as part of the quotation package. It is the Contractor's responsibility to ensure that NARA is not provided counterfeit products. In the event that such information technology products are determined to be counterfeit, NARA will seek all available legal remedies, including criminal prosecution. Counterfeit information technology product means any item of information technology, including hardware and software that is an unauthorized copy, replica, or substitute. Supplies furnished under this RFQ are of domestic origin unless otherwise indicated by Contractor. The following types of software products within this solicitation are required to be IPv6 compliant: all operating systems and all server interface software packages. The following types of software products within this solicitation are required to be compliant with Section 508: operating systems and business productivity software. Any representations and/or certifications attached to this RFQ must be completed by the contractor. DELIVERY: Delivery must be undertaken during regular business hours, Monday through Friday, unless mutually agreed upon by NARA and the Contractor. Delivery will be made to the following location unless otherwise agreed upon by the parties: NARA - AII; 8601 Adelphi Rd. College Park, MD 20740-6001 no later than 30 calendar days after issuance of the purchase order. Failure to deliver in a timely manner could result in termination. ENCLOSURES: Enclosure 1, Schedule of Prices; Enclosure 2, Required Quote Information; Enclosure 3, Terms and Conditions; Enclosure 4, Additional NARA Terms and Conditions (Addenda to FAR clause 52.212-4); and Enclosure 5, Government Product Accessibility Template (GPAT). PERIOD OF PERFORMANCE: Base Year (June 25, 2013 through June 24, 2014). Option Year I (June 25, 2014 through June 24, 2015). Option Year II (June 25, 2015 through June 24, 2016). EVALUATION: Evaluation and purchase order issuance will be in accordance with the procedures of FAR Subpart 13.106, Soliciting Competition, Evaluation of Quotations or Offers, Award and Documentation as authorized by FAR Subpart 13.5, Test Program for Certain Commercial Items. The purchase order will be issued to the contractor whose conforming quotation in response to the RFQ will be most advantageous to the Government. Best value for this competition will be based on a lowest priced technically acceptable evaluation. In order to be determined technically acceptable, all quotation submission requirements must be met including the required documentation submissions outlined herein. Contractors must complete and return Enclosure 2, RFQ Information Sheet, in order for its quotation to be considered. The Government reserves the right to issue a purchase order on the initial quote without discussions of this procurement. The following FAR clauses are incorporated and are to remain in full force in any resultant firm-fixed price purchase order, with the exception of FAR provisions which will be removed prior to award: FAR 52.212-1, Instructions to Offerors – Commercial Items (Feb 2012); FAR 52.212-3, Offeror Representations and Certifications – Commercial Items (Dec 2012) – Offerors shall complete only paragraph (b) of this provision if the offeror has completed the annual representation and certifications electronically via https://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the ORCA website ( https://www.sam.gov ), the offeror shall complete only paragraphs (c) through (o) of this provision; FAR 52.212-4, Contract Terms and Conditions – Commercial Items (Feb 2012) – see Enclosure 4, Additional NARA Terms and Conditions (Addenda to FAR Clause 52.212-4) for addenda to this clause; FAR 52.212 - 5, Contract Terms and Conditions Required to Implement Statues or Executive Orders – Commercial Items (Jan 2013) – see Enclosure 3, Terms and Conditions for the full text of this clause and for additional applicable FAR provisions and clauses. QUESTIONS: Questions regarding this RFQ must be submitted in writing to Mr. James Philiposian (Contractor) at james.philiposian@nara.gov no later than 12:00 PM ET on June 6, 2013 to be considered. Questions submitted in any other manner will not be answered. The Government will answer questions or requests for clarification via a written RFQ amendment. RFQ CLOSE DATE: Quotations should be received by 4:00 P M ET on June 17, 2013. Failure to submit quotations by the due date may result in rejection of the quotation as untimely. Contractors submitting via e-mail are cautioned that e-mails containing attachments in excess of 25 megabytes (MB) will be rejected by NARA’s e-mail system. Contractors are advised to confirm receipt of quotations. Telephonic responses will not be processed. QUOTATION SUBMISSION INSTRUCTIONS : Contractors may either email one (1) copy the quotation to: james.philiposian@nara.gov or mail one (1) hard copy and one (1) CD of its quotation to National Archives and Records Administration (NARA), Attention: James Philiposian (Contractor), 8601 Adelphi Road, Room 3340, College Park, MD 20740-6001.
