- Notice of Intent to Award Contract under an Exception to Full and Open Competition This is a notice of intent to award a bridge contract to NTT Data Federal Services in accordance with the exception to full and open competition provided at FAR 6.302-1. The contract to be awarded is for EDGAR System transition services and to continue the current turn-key EDGAR System support services until the EDGAR System contact is transitioned to multiple other contract vehicles through the competitive awards and other actions outlined below. This contract action is vital in order to allow for the critical EDGAR system to continue functioning without interruption or degradation during the transformation of the EDGAR System support contract to multiple successor contracts to align with the SEC Office of Information Technology's (OIT) enterprise-based Information Technology (IT) strategy. The enterprise-based IT strategy organizes IT-related needs into high level functions of Application Management, Infrastructure Operations Management, and Development/Enhancements. The following represents ongoing and planned procurement actions to successfully achieve this IT strategy: 1) The SEC plans to acquire services for EDGAR Development as a competitive task order under the pending Division Information Office Application Modernization Development and Support (DIOMDS) multiple award, Indefinite Delivery/Indefinite Quantity Contract (RFP No. SECHQ113R0004). It is anticipated that the DIOMDS EDGAR task order award will be made by November 2013. The award will be followed by an estimated four to six month transition of EDGAR system knowledge and support responsibility from the contractor under the bridge contract to the new EDGAR Development contractor. 2) EDGAR Application Maintenance Support and Public Dissemination Service (PDS) requirements will be transitioned to OIT's Applications Operational Support Services (AOSS) contract. The RFQ was released on the NIH's Information Technology Acquisition and Assessment Center (NITAAC) GWAC on June 12, 2013 as a small business set-aside. It is anticipated that the new re-competed AOSS contract will be awarded in September 2013. The award will be followed by the transition of system knowledge and support responsibility to the new contractor between October 2013 and January 2014. 3) EDGAR Configuration Management support requirements will be transitioned to OIT's Confirmation Management/Quality Assurance (CM/QA) support contract. It is anticipated that the new re-competed CM/QA contract will be awarded in November 2013. The award will be followed by the transition of system knowledge and support responsibility to the new contractor between January 2014 and April 2014. 4) EDGAR Infrastructure Operations Management support will be transitioned to OIT's existing Enterprise Information Technology Support Services (ISS) contract. It is anticipated that the award of the contract modification to the ISS contract to cover EDGAR support will be completed by August 2013. This action would be followed by the transition of system knowledge and support responsibility to the new contractor between October 2013 and January 2014. To mitigate mission risk, transition execution will not occur during the physical move of the SEC's alternate data center from Alexandria, Virginia to Edison, New Jersey during August and September 2013. When the ISS contract is re-competed in the future, the EDGAR Infrastructure Operations Management support requirement will be included. 5) EDGAR Security Management will be transitioned to OIT's existing Security Support contract. The transition of applicable system knowledge and support responsibility will be a part of the transition of EDGAR Infrastructure Operations Management between October 2013 and January 2014. Each of these transitions will require the EDGAR support contractor to provide knowledge transfer, training, and oversee an effective and timely transition of all covered EDGAR functionality to the new contractor. In addition to the transformation of the EDGAR Support contract from a single contract to the multiple contracts outlined above, the SEC expects other significant EDGAR-related operational and regulatory activity in the coming months that supports the noticed contract action. In particular, the SEC is moving its Alternate Data Center (ADC) to a new location in August 2013 and is anticipating critical rulemakings in late 2013 and early 2014 that will require major changes to the EDGAR functionality. Accordingly, the SEC requires a contractor with the capabilities to safely and efficiently accomplish the pending contract transitions, while also handling the EDGAR-related ADC move and implementing significant rulemakings in the first several months of the bridge contract period of performance. This bridge contract is planned to be awarded with Firm Fixed Price (FFP) CLINs and is estimated to have a period of performance of eleven months from commencement of work (August 01, 2013 - June 30, 2014). As outlined above, significant aspects of the work are expected to be transitioned to other contract vehicles prior to the completion of the full period of performance. This notice of intent is not a request for competitive proposals. However, all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Interested persons may identify their interest and capability to respond to the bridge contract requirement or desire to submit proposals for the bridge contract only. Sufficient information should be included to demonstrate sufficient detailed knowledge of the system to successfully continue operations and maintenance, new development, application maintenance, and system security while simultaneously transitioning work streams in a timely and effective manner to new contractors in accordance with the enterprise-based IT strategy outlined above. All responses received no later than the closing date of this announcement will be considered by the Government. The Government will notify parties of the outcome of any proposal submitted in response. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
