- The US Army Medical Research Acquisition Activity (USAMRAA) intends to solicit and award a sole source, firm-fixed price contract, under Federal Acquisition Regulation (FAR) Part 12 Acquisition of Commercial Items, and FAR Part 13 Simplified Acquisition Procedures (SAP), under the sole source authority of FAR Subpart 13.106-1(b) for CommVault Software and Support through authorized resellers. The solicitation is W81XWH-13-T-0233. NAICS 511210/size standard $35.5. The data backup application technology proposed in this request represents continuation of an existing technology solution, CommVault. CommVault's product was originally selected as the enterprise wide data backup solution because it met all operational requirements. It is imperative that the HA/TMA network deploy consistent architecture to ensure continuity of network architecture, functionality and compatibility. This is extremely important in the area of continuity of operations and disaster recovery planning. Introducing and/or allowing other OEM products to compete for this particular requirement would require a complete recompete of the enterprise data backup system. Thus, procuring other solutions and an award to any other source will result in a significant cost to the Government which will not be recoverable through competition. Consequently, an award will be made to CommVault authorized resellers. This is not a request for competitive proposals and is not to be construed as a commitment by the Government. However, all responsible sources may submit a capability statement, proposal or quotation, which will be considered by the Agency. No cost will be incurred by the Government for submittals in response to this notice. The Government will consider all responses received within 15 days of the publication of this notice. A determination by the Government not to compete this acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered exclusively for the purpose of determining whether to conduct a competitive procurement.
