DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 6, Network Contracting Office, VA Medical Center, Hampton, Virginia. The 2237 number is 558-13-3-075-0281. 2.Nature and/or Description of the Action Being Processed: This is a sole source justification for the procurement of Olympus America, Inc.'s FK TORS Davinci Robotics Retractor for VAMC Durham, NC. 3.Description of Supplies/Services Required to Meet the Agency's Needs: VAMC Durham requires: "1 FK-WO TORS Laryngo Pharyngoscope Retractor $26,640.00 "1 Laryngoscope Holder and Chest Support with Rod $1,225.80 "1 Flexible Tension Arm, L-Stand 470X170 MM $6,840.00 "1 Clamp Socket for Hinged Arm Support $1,889.90 "1 Adapter for Retractor/Laryngoscope $227.70 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): VAMC Durham has the Davinci Robot on station with the capability to provide preventive cancer surgery to the larynx and pharynx with the use of a compatible retractor to allow the instruments sufficient maneuvering room. Olympus has submitted in writing that their item is proprietary technology for the Trans Oral Robotic Surgery procedure. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: "Sources Sought" notice (VA246-13-Q-1385) was published from 05-22-13 through 05-24-13 with salient characteristics required that concluded with one respondent (Olympus). 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated price of $36,833.40 to the Government (a 10% discount off from the normal listed price) has been determined fair and reasonable by the Contracting Officer. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conduct on the web using key words "types of retractors surgical with davinci robot." Limited information on responsible sources was found while the results of the Sources Sought notice with the results also confirmed the decision to sole source this requirement. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: See above. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Firm 1: Olympus America, Inc. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Market research will be conducted for subsequent acquisitions to ensure fair and open competition.
