- JUSTIFICATION AND APPROVAL FOR A LIMITED SOURCE AWARD UNDER A FEDERAL SUPPLY SCHEDULE 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, NJ 07724 2. Description of Action: The proposed action is for a 13-month Firm-Fixed Price Order for Statistical Analysis System (SAS), Enterprise Business Intelligence (EBI), Operations Research (OR) software maintenance and technical support. This effort is proposed to be awarded on a sole source basis to Executive Information Systems (EIS), 6901 Rockledge Drive, Suite 600, Bethesda, MD, 20817, under General Services Administration (GSA), Federal Supply Schedule (FSS) 70, Contract GS-35F-0170K. 3. Description of the Supplies or Services: The proposed action is to provide for SAS/EBI/OR software maintenance and technical support for existing Version 9.2 SAS/EBI/OR software presently in use by VA's Office of Performance Analysis and Integrity (PA&I). SAS/EBI/OR software allows PA&I to distribute the results of analytics to end-users operations and system process optimization. SAS software enables PA&I to work in an integrated, compatible environment, reducing development time, and leveraging SAS datasets. Continued software maintenance and technical support is required to provide necessary technical support, patches, and upgrades to the existing SAS software presently in use. The period of performance shall be 13-months. REDACTED 4. Authority: Federal Acquisition Regulation (FAR) Part 8.405-6(a)(1)(i)(B), Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. 5. Rationale Supporting Use of Authority Cited Above: The proposed source for this action is EIS. EIS is the exclusive authorized reseller of Version 8.0 and later of the SAS software maintenance and technical support as detailed in the market research section. The SAS software provides an integrated environment for predictive and descriptive modeling, data mining, text analytics, forecasting, optimization, simulation, and experimental design. Only SAS offers an integrated suite of analytics software that provides the interoperability and compatibility with VA's current environment. SAS software is the only complete functional statistical program that can be utilized by PA&I because of the compatibility with existing data throughout VA. This request is to provide software maintenance for SAS Version 9.2 software currently installed and in use on user work stations. Failure to have the subject software maintenance and technical support will result in an inability to receive software updates, including security patches. Without this analytical software supporting PA&I, VA will not have the latest analytical support for patient safety and healthcare outcomes initiatives, which are becoming increasingly large and complex. Using alternative products will require additional custom code to be developed and maintained externally for the products purchased. This is a brand name justification in support of FAR 11.105, Items Peculiar to One Manufacturer. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government's requirements. There is no competition anticipated for this acquisition. Procurement data does not include any unnecessary requirements that may inhibit competition. The ordering activity will post the justification along with the Request for Quote (RFQ) to e-Buy in accordance with FAR 8.405-6(d). Additionally, this action will be synopsized at award on the Federal Business Opportunities (FBO) website in accordance with Far 5.301. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be fully competed. 8.
