- This solicitation is being posted to both the Federal Business Opportunities (FBO) page located at http://www.fbo.gov/ and the Navy Electronic Commerce on Line (NECO) site located at https://www.neco.navy.mil/ While it is understood that FBO is the single point of entry for posting of synopsis and solicitations to the internet, NECO is the alternative in case FBO is unavailable. Please feel free to use either site to access information posted by NSWC Crane. The Government intends to enter into a Firm-Fixed-Price (FFP) contract with American Rheinmetall Munitions, Inc. (ARMI), 125 Woodstream Boulevard, Suite 101, Stafford, VA, CAGE D2014, in accordance with the statutory authority 10 U.S. C. 2304(c)(1) as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. This proposed procurement is for MK281 40mm Practice Grenade Cartridges in accordance with MOD 0: ADL 53711-8502192, NSN 1310-01-472-9871, Specification 12255-OES-PRF-0118; MOD 1: ADL 53711-8502193, NSN 1310-01-530-8878, Specification 12255-OES-PRF-0119; MOD 2: ADL 53711-8502194, NSN 1310-01-586-9867, Specification 12255-OES-PRF-0120; MOD 3: ADL 53711-8502195, NSN 1310-01-586-9864, Specification 12255-OES-PRF-0121; as well as associated drawings, Contract Data Requirements List, Quality Assurance Provisions and Supplementary Quality Assurance Provisions. This acquisition is under North American Industry Classification System code (NAICS) 33993 - Ammunition more than 30mm. Award of a 5-year firm-fixed price Indefinite Delivery/Indefinite Quantity (IDIQ) contract is anticipated. Delivery terms for production units is 430 days after effective date of contract. This is a non-commercial acquisition and the final contract award decision will be based upon a fair and reasonable price determination. The anticipated minimum/ maximum contract quantities by MOD are: MK 281 MOD 0 - 0/79,712 each; MK 281 MOD 1 - 0/59,712 each; MK 281 MOD 2 - 10,000/ 60,056 each; MK 281 MOD 3 - 0/58,272 each. The Government requires 416 First Articles of each MOD within 180 days after contract award. The First Articles will not be delivered as part of the production quantity. The Lot Acceptance Test (LAT) sample submission is due within 120 days of First Article Test approval, with production lots due 30 days after the LAT report approval. First Article Test and LAT are Contractor tested at origin. Initial inspection will be by Quality Assurance Representative at source, with final acceptance at Destination. Delivery is required FOB Destination. The proposed contract action is for supplies for which the Government intends to solicit and negotiate with only one responsible source under the statutory authority 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1. The basis for restricting competition is the Government does not own the proprietary rights to the technical data. ARMI owns the proprietary designs for these cartridges, including the detailed drawings, hardware and tooling. The Contractor must be properly registered in the Government(s) System for Award Management (SAM) in order to receive an award. No solicitation will be available at FedBizOpps and NECO and no hard copies of the solicitation will be mailed. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Offers must be submitted in the format specified in the solicitation. For changes made after the closing date, only those offerors that provide a proposal will be provided any changes/amendments and considered for future discussions and/or award.
