Description
NATIONAL AERONAUTICS AND SPACE ADMINISTRATION NASA SHARED SERVICES CENTER LIMITED SOURCE JUSTIFICATION I recommend/request that NASA, NASA Shared Services Center (NSSC) negotiate with Skillsoft only for continued support of the services contracted for related to online custom content. This action will be performed against GSA Schedule 874 (General Purpose Commercial Information Technology Equipment, Software and Services) Contract GS-02F-0040L. The period of performance will be for one year from July 1, 2013 through June 30, 2014. The total estimated amount including options is $XXX,XXX.XX. This procurement is for the renewal of annual software maintenance services for the Agencys E-Learning Content Solutions and Hosting services that supports a user base of 75,000 users Agency-wide. The services will consist of the following: 1.10,000 license Leadership Development Channel video products. 2.1,000 license EngineeringPro. 3.Knowledge Center portals. 4.Live Virtual instructor-led training services. 5.Business Exploration Series. 6.10,000 license Online Books24X7 Collections with chapters to go. 7.10,000 license SkillChoice Complete with Legal Compliance including ITPro, BusinessPro and Office Essentials. This recommendation ismade pursuant to FAR 8.405-6(a)(1)(i)(B), which implements the authority of the Multiple Award Schedule (MAS) Program cited in FAR 8.401 pursuant to Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251) and Title 40 U.S.C 501, Services for Executive Agencies, for the acquisition of supplies or services when only one source is capable of providing the supplies or services required at the level of quality required because of the supplies or services are unique or highly specialized.Competition is impractical for the following reasons: 1.Additional costs to NASA would be incurred for the removal of all current Skillsoft courses from the NASA catalog. The total cost to NASA in addition to actual service costs is estimated to exceed $XX,XXX.XX, or XX% of the base year estimate. These costs are for the following additional NASA activities required to support a change in vendor: a.There are 3,595 courses in the NASA catalog and it is estimated removal would require 40 hours of SATERN Level 2 Administrator Support. b.Additional costs to NASA would be incurred for the removal of all current Skillsoft courses from existing course curricula. There are 73 curricula containing 624 Skillsoft courses in SATERN. It is estimated that removing it would require 16 hours of SATERN Level 2 Administrator Support. c.Additional costs to NASA would be incurred for the removal of all current Skillsoft courses from existing learners learning plans. There are currently 133,001 Skillsoft courses in 70,053 Learners Learning Plans. It is estimated that removing it would require 80 hours of SATERN Level 2 Administrator Support. It is difficult to accurately project or estimate the cost of re-work involved with employees and supervisors who would be required to modify/update learning plans and Individual Development Plans due to a change around these services. d.Any other solution than Skillsoft would be a degradation of services related to Training Support and the SATERN Learning Management System (LMS) experience resulting in a disruption to the continuity of services for an extended period, which would cause excessive delays and prevent the Agency from completing important training. A change of vendors at this time would also impact the NSSC with a significant increase in customer call volume related to SATERN and the online content support. We estimate the impact to be an additional 80 hours in the Customer Contact Center for SATERN Level One support. 2.SkillSoft has extensive experience working with Federal Agencies (USAF, US Army, IRS, EPA, NASA, DOI, etc.), whereby a robust catalog of courses have been developed, used and accepted by the aforementioned Agencies, including NASA. Consequently, there are 103,868 SkillSoft courses on the learning plans that are currently accessible by 73,000 Agency employees. Market research via the Federal Supply Schedule e-Library indicates no other contractor has the requisite portfolio to duplicate what is currently being offered by Skillsoft and utilized by NASA employees. 3.Skillsoft offers Auditor training requirements and Agency elevated privileges that utilize a significant number of courses to meet requirements to maintain system administrator accounts on local systems. These additional features are offered exclusively by Skillsoft as well as the Project Management Certification process, which no other offeror has demonstrated to provide. 4.Finally, other impacts to consider include the work external to the NSSC and SATERN that would have to be completed to support a new vendor for these services. The SATERN Splash Page would have to be modified to remove references to Skillsoft. The NASA People web site would require all references to Skillsoft be removed and sanitized. Likewise, the SATERN Info web site would require all references to Skillsoft be removed. References to SATERN Mobile (MARS) would have to be removed. The SATERN Project web site must have references to Skillsoft removed. Any change to the current service is cost prohibitive and would cause a substantial disruption to the Agencys training capabilities. Moreover, a move away from the current solution is clearly not in the best interest of the Agency. Pursuant to FAR 8.404, BPAs or orders placed against a MAS, using the procedures in this subpart, are considered to be issued using full and open competition. Therefore, when establishing a BPA or placing orders under Federal Supply Schedule contracts using the procedures of 8.405, ordering activities shall not seek competition outside of the Federal Supply Schedules or synopsize the requirement. However, the Limited Source Justification will be synopsized at www.fedbizopps.gov within 14 days after award pursuant to FAR 8.405-6(a)(2). Pursuant to FAR 8.404 (d), GSA has already determined the prices of supplies and fixed-price services, and rates for services offered under schedule contracts to be fair and reasonable. Therefore, NASA is not required to make a separate determination of fair and reasonable pricing. Market research conducted included a search of the internet and the GSA Schedules that showed Skillsoft may offer their services through one or more Small Business Value Added Resellers (VARs). Should NASA be able to identify a viable VAR, award will be made utilizing the Skillsoft GSA Contract (GS-35F-02F-0040L). Due to the specialized nature of this requirement, there are no immediate actions which the agency may take to remove or overcome barriers to competition before any subsequent acquisition for the services required.However, the Agency will increase market research activities in an effort to obtain competition prior to executing the renewal of this requirement. I hereby certify the facts in this justification and any supporting data used for this justification are accurate and complete to the best of my knowledge.
