- U.S. Customs and Border Protection (CBP) intends to negotiate a Firm Fixed Price (FFP) contract on a sole source basis under authority of FAR 13.106-1(b)(1) with SDL Atlas Textile Solutions 3934 Airway Drive; Rock Hill, SC 29732 to provide a Rain Tester with 1500MM COLUMN. The CBP Savannah, GA Laboratory is requesting the procurement of this apparatus to include an abrasion machine, abrasive cloth, circular cutting device and supplies as per the following: • The test apparatus consists of a sink fitted with a 1500mm tall column, controls for the functions to be calibrated to NIST traceable standards and the running of the tests, sample holder and a recirculating tank. The functions that are calibratable are to be water temperature, water pressure and length of time of the water spray. Laboratories and Scientific Services (LSS) within the Office of Information and Technology (OIT) is the Forensic/Scientific arm of the CBP providing forensic and scientific testing in the area of Trade Enforcement, Weapons of Mass Destruction, Intellectual Property Rights, and Narcotics Enforcement. In the area of Trade Enforcement, assisting fellow CBP employees in the classification of imported commodities for the correct assessment of tariffs and duties is essential in protecting the revenue of the United States. Within LSS, textile teams are constantly assessing the analytical needs of the laboratory system. These needs are usually driven by one of two reasons: 1) the updating of scientific instrumentation and 2) by the constantly changing HTSUS. In the case of the Rain Tester built by SDL Atlas, the measureable set points for the test, namely water pressure, water pressure and the time length of the actual test can now be set and automatically calibrated by the instrument. This frees up the analyst to prepare more samples to be run by the instrument in a shorter amount of time with better precision and accuracy. The SDL Atlas Rain Testers are currently used in the Houston Southwest Regional Science Center and New York Customs Laboratories. Imported merchandise entered as "water resistant" is required to meet specific criteria set forth in Chapter 62 of the HTSUS. This instrument will be used to determine the water resistance of those commodities in Chapter 62 as per Additional US Note 2. The duty rate for garments that meet the criteria is significantly lower than the almost identical garments that do not meet the criteria. Therefore, precision and accuracy is essential in the running of the test and that it be repeated as prescribed in CBPL 62-02 just as accurately and precisely. Due to internal quality issues, it is critical for uniformity among the textile teams in the CBP laboratory system to have the same results when running the same test material. Archived data and quality control in the form of control charts and archived quality documents are important and necessary. It is critical to maintain consistency among the teams throughout the country and maintain our quality accreditation with the American Association for Laboratory Accreditation and our upcoming audits for accreditation by the American National Standards Institute. Laboratory accreditation is critical to acceptance of results as evidence when dealing with potential criminal and civil litigation and court cases. The North American Industry Classification System (NAICS) code for this acquisition is 334516, Analytical Laboratory Instrument Manufacturing. The Government intends to solicit and negotiate directly with SDL Atlas Textile Solutions. This notice of intent is not a request for competitive proposals. However, all parties who identify their interest and capability to satisfy this requirement will be considered. No solicitation will be issued, therefore, all requests for the solicitation will be considered non-responsive. A determination not to compete this action based upon responses received is in the sole discretion of the Government. All interested parties must express their interest and capabilities in writing via e-mail to brice.winston@dhs.gov prior to the closing date of this notice. An award shall be made to SDL Atlas Textile Solutions. The anticipated award date is July 10, 2013.
