Approved Justification and Approval with redaction. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Under Federal Acquisition Regulations (FAR) Subsection 6.302-2 Unusual and Compelling Urgency Upon the basis of the following justification, I, as Competition Advocate for the General Services Administration, Northwest Arctic Region, Public Buildings Service, hereby approve this unusual and compelling justification pursuant to the authority of Section 253, Competition Requirements, of United States Code, Title 41: Public Contracts (41 U.S.C. 253). 1. Identification of agency and contracting activity: The requiring activity is the General Services Administration (GSA), Public Buildings Service (PBS), Region 10, Service Center Division, Greater Puget Sound Service Center (GPSSC), located at 400 15th Street, Auburn, WA 98001. The contracting activity is GSA, PBS, Region 10, Design and Construction PBS points of contact for this action is Contract Specialist Keith Goodsell, who can be reached at (253) 931-7775. 2. Nature and description of action being approved: The proposed action is to expedite the procurement and award of a competitive, limited source fixed price contract for urgent truss repairs within the GSA Auburn Warehouse Complex located in Auburn, Washington. Competition will be restricted to small businesses responding with capabilities statement to the Source Sought Notice posted to Federal Business Opportunities (FBO) on May 10, 2013. The timeframe between issuance of the solicitation and receipt of proposals will be compressed to a ten calendar days, in order to meet required delivery dates. The award will include construction services to complete critical repairs at 79 known locations, with optional line items for an unknown quantity of additional repairs that are projected to be needed due to the progression at which damages have been occurring within the facilities. 3. Description of Supplies/Services: The requirement is for construction services for the repair of currently identified damaged roof trusses at the Auburn Complex. Damage to be repaired is present in Warehouses 3, 4, 6 and 8, as well as in Building 7 (SSA). In addition, there is the potential for an unknown amount of additional truss repairs that may be required to be repaired both during the course of the construction and the subsequent winter that follows. Based on the results of the facility survey completed in late April 2013, GSA engineers believe truss members may be fracturing due to long term fatigue and past pulse loads under normal loading. Should additional "normal load" damage occur within a currently damaged truss or adjacent to existing damaged truss, the trusses' ability to redistribute load could be severely compromised and a structural failure could occur. The rough order of magnitude (ROM) for the repairs is "redacted" estimated for predicted foreseen and future conditions. Prior to the April 2013 post-winter truss inspection, GSA engineers believed that the truss damage was a result of the heavy snowfall that occurred in January of 2012. The April 2013 inspection revealed significant damage that, due to the light winter on 2012/2013, cannot be attributed to any specific environmental event. Therefore, damage is occurring due to extended service life and additional damage could occur without any warning or apparent initiating event. If damage occurs to already damaged trusses, the trusses may not be able to redistribute load to adjacent members and a significant failure could occur. Redacted Notes: Building 7 will be in occupancy through winter of 2013/2014. The four warehouses may also remain occupied during that period. Should a significant snow event occur, substantial additional reinvestment may be required. Additional services for FY13 and FY14 are calculated by building, with the not-to-exceed (NTE) amounts equaling aggregate totals for all buildings for each period of performance (POP) listed. 4. Authority and Demonstration that nature of the acquisition requires use of the authority cited: Under the authority of 41 U.S.C. 253 (c.)(2), Federal Acquisition Regulations (FAR) Subsection 6.302-2 allows for other than full and open competition in circumstances where there is unusual and compelling urgency and delay in award of a contract would result in serious injury, financial or other, to the Government. Structural consultant KPFF Consulting Engineers, Inc. (report, dated 04/22/2013), performed a post winter inspection to verify that no additional truss damage occurred during the light winter of 2012/2013. Unexpectedly, significant damage beyond the damage previously reported was identified. Therefore, it appears that damage is occurring due to long term fatigue and pulse loading within the facility. It is not possible to predict when addition damage of this sort will occur. However, should additional damage occur adjacent to unrepaired damage, the trusses ability to redistribute loads will be significantly compromised and could result in a significant structural failure. Failure to make truss repairs in these facilities will result in the high risk of injury to occupants, property damage to the Government through damage and destruction "redacted" spare parts located within those buildings, "redacted". Without repairs, extended operational shutdown would significantly impact the agencies mission with potential for material destruction and agency displacement from structural collapse. The repairs will return the roofs to an acceptable live load capacity of four inches of snow. These buildings are currently leased by Department of Defense agencies; "redacted" The remainder of space in Building 8 is leased by Department of Navy, who utilizes the space as a storage facility for the submarine base. A shutdown of these facilities would negatively impact the missions of both of the above listed agencies. Building 7 is occupied by the Social Security Administration (SSA). It is for the urgent and compelling reasons mentioned above that the authority cited for this action is appropriate. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. The gravity of the situation warrants the need for expedited action pursuant to the authority cited for the reasons stated above. The compressed solicitation schedule of ten calendar days is necessary to ensure that known repairs start and finish as soon as possible and by the required delivery deadline. Construction contractors are required to have specialized skills in the repair of 1940s era wooden trusses, including quick disassembly and assembly of metal split-ring connected member joints, full and partial chord member replacement, chord splicing, combination repairs, center plug repairs, epoxy encapsulation/injection, as well as other industry standard types of repairs. In addition to the above mentioned specialized services, the construction contractor will be required to have extensive experience in the use of scaffolding and shoring in support of repairs to load bearing trusses, as well as have the capacity to complete multiple repairs in multiple locations both sequentially or simultaneously, and to provide both scheduled and on-call truss repairs at all hours, including days, nights, weekends, and holidays during the period of performance. 6. Description of Efforts made to ensure that offers are solicited from a many potential sources as practical: Competition will be limited to only those firms that submitted statements of capabilities, in response to the Sources Sought Notice posted to FBO on May 10, 2013 as noted in Section 2 above. This effort will help to ensure that the Government will receive proposals from the small business firms that both believe they are qualified to perform the work and have expressed an interest in the work. In addition to limiting competition to only those firms that submitted statements of capabilities, the response time will be shortened from 30 to 10 working days. Due to the time constraints for completing the repairs, a 30 day response time is not practical. It is anticipated that 10 days will be sufficient for the prospective offerors to submit put together a proposal. If requests are received for more time the Contracting Officer will consider granting additional time if it's in the Government's best interest. The appraisal value of each warehouse is approximately $17 million, while the Department of Defense materials and supplies stored in these buildings are estimated to be in the "redacted" of dollars. Failure to repair the broken trusses in these facilities may lead to further damage to the point where occupancy is no longer feasible. 7. Facts support the use of other than full and open competition: Due to the urgent and compelling circumstances noted above driving the schedule for this project, the only reasonable and prudent response for the GSA to act is rapidly to ensure that the necessary repairs are completed as soon as possible, in order to prevent serious damage to the Government. 8. Determination of a Fair and Reasonable Price: Limited competition will help to ensure that the Government receives a fair and reasonable price. The Contracting Officer will take sufficient measures to ensure fair and reasonable prices are obtained through award of a fixed price contract. A Source Selection Decision Document will record the fair and reasonable price determination and capture the pricing environment, information relied upon, best value analyses findings, and basis for such determination. 9. Description of Market Research Conducted: On May 10, 2013, a sources sought notice was posted to the Federal Business Opportunities (FBO) seeking qualified small businesses with extensive experience in wooden truss repair experience, specifically with split-ring connector technology, epoxy encapsulation/injection, shoring, and scaffolding. Interested parties with the requisite experience were requested to submit a capabilities statement before the notice's closing on May 17, 2013. Research was also conducted using the U.S. Small Business Administration's Small Dynamic Business Search, and the Department of Veterans Affairs VetBiz.gov websites, as well as GSA national and regional contracting construction contracting vehicles. 10. Sources Expressing an Interest in the Acquisition: Seven firms responded to the FBO source sought notice, including three businesses that were marketing services to potentially interested parties including business integration, legal and proposal preparation services. The four other businesses that responded to the notice provided statements of capabilities for the prospective firm, as was requested in the sources sought notice. 11. Steps To Remove Or Overcome Any Barriers To Competition: Limited competition will be sought for this urgent procurement. As such, only minor barriers to competition exist. The situation was not anticipated and as such, the GSA is taking the action to award a fixed price contract as noted above, as a prudent step to ensure the construction services are procured, awarded, and executed as soon as possible. In the future, the GSA will conduct more frequent monitoring of the facilities to be able to identify and find a more timely solution that allows for greater competition.
