- Description
- This is a Project Labor Agreement survey only. NAVFAC Pacific will use the responses to this survey to make the appropriate acquisition decisions for the planned procurement. NAVFAC Pacific is soliciting comments from the construction community addressing the potential use of Project Labor Agreements (PLA) for this project: This is a design-bid-build project for the renovation of an existing hangar. The building spaces will provide shop spaces, storage, conference rooms, private offices, general administrative areas, showers/toilets, operation rooms, communications rooms, and equipment maintenance rooms. The work includes selective demolition, interior/exterior painting, interior and exterior doors, masonry walls, metal stud and gypsum board walls, acoustical ceiling panels, interior finishes, fire sprinkler, fire and security alarm systems, Aqueous Film Forming Foam (AFFF) system, sanitary sewer systems, electrical power and lighting, HVAC systems, passenger/freight elevators, bridge cranes, plumbing systems, and incidental related work. Site preparation includes site clearing, excavation, grading, fencing, generators, pad-mounted transformer, primary and secondary distribution systems, telecommunications infrastructure, compressed air, water distribution systems and AFFF industrial waste systems. NAICS Code: 236220 - Construction of Buildings, Commercial and Institutional Building Construction. The magnitude of construction for this project is between $25,000,000.00 and $50,000,000.00. Prime contractors must self-perform 20% of the work. The estimated period of performance is 730 calendar days. A PLA is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement as described in 29 U.S.C. 158(f). Federal Acquisition Regulation (FAR) Policy states: Project Labor Agreement (PLA) is a tool that agencies may use to promote economy and efficiency in Federal procurement. Pursuant to Executive Order 13502, agencies are encouraged to consider requiring the use of project labor agreements in connection with large-scale construction projects. An agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree, for that project, to negotiate or become a party to a project labor agreement with one or more labor organizations if the agency decides that the use of project labor agreements will (1) advance the Federal Government's interest in achieving economy and efficiency in Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters; and (2) be consistent with law. Reference: Provision: FAR 52.222-33 Notice of Requirement for Project Labor Agreement, and Clause: FAR 52.222-34 Project Labor Agreement. In consideration of the above factors, and any others which may be deemed appropriate, the construction community is invited to comment on the use of PLAs. Of particular interest to the Government are responses to the following questions: 1. Have PLAs been used on comparable projects undertaken by the public or private sector in Hawaii? If so, please provide supporting documentation. 2. Does the local market have sufficient number of available skilled workers for this project? Are there other projects in the vicinity that will limit the pool of skill labor available for this project? Please elaborate and provide supporting documentation. 3. Are you aware of any past or current labor strikes or disputes that may impact this project? If so, please elaborate and provide supporting documentation. 4. Which Collective Bargaining Agreements will expire during the course of the project that may cause delays? 5. Could a PLA contribute to cost savings in any of the following: a. Harmonization of shifts and holidays between the trades to cut labor costs? b. Minimizing disruptions that may arise due to expiration of Collective Bargaining Agreements? c. Allowing for changes in apprentice-to-journeyman ratio? d. Serving as a management tool that ensures highly skilled workers from multiple trades are coordinated in the most efficient way? 6. Could a PLA minimize risk and contribute to greater efficiency in any of the following ways: a. Mechanisms to avoid delays? b. Compliance with Davis-Bacon and other labor standards, safety rules, EEO and OFCCP laws? c. Ensuring a steady supply of skilled labor in markets with low supply or high competition for workers? 7. Identify specific reasons why you do not believe a PLA would advance the Federal Governments interest in achieving economy and efficiency in federal procurement. 8. Could a PLA increase costs on this project? If so, please elaborate and provide supporting documentation (if any). This is not an announcement of the availability of a solicitation nor is it a means of generating a plan-holders list. After review of the responses to this synopsis, a pre-solicitation announcement will be published in the Federal Business Opportunities (FedBizOps) if the Government intends to proceed with the procurement of these services. The Government will not contact the concern for clarification of information. This survey is for planning purposes only and shall not be construed as a Request for Proposal or as an obligation on the part of the Government. The Government does not intend to award a contract on the basis of this market survey or otherwise pay for the requested information. The Government will not provide a debriefing on the results of this survey. All information will be held in a confidential manner and will only be used for the purposes intended. The construction community is invited to answer and comment on the use of a PLA for the above titled project. Responses shall be submitted via email to Ann Saki-Eli at ann.sakieli@navy.mil no later than 10:00 a.m. (HST) on 18 July 2013.
