- This contract action was accomplished using other than competitive procedures because the procurement is awarded to a sole source under the Test Program for Certain Commercial Items (FAR 13.5). See posted J&A for further information. MEMORANDUM FOR RECORD FOR OTHER THEN FULL AND OPEN COMPETITION PRIORITY 03 1. Contracting Agency: Southern Regional Contracting Office, Fort Sam Houston, TX 78234 2. Description of Action: Priority 03 urgent order for Tornier Affinity total Shoulder Implant needed to treat a patient with severe glenohumeral joint arthritis. 3. Description of Products/Services: This requirement is for a shoulder implant needed for surgery at San Antonio Military Medical Center (SAMMC), Ft Sam Houston, TX. The implant replaces the entire shoulder to include glenohumeral joint. 4. Authority Cited: 10 U.S.C. 2304(c)(2) is implemented by FAR 6.302-2(a)(2) Unusual and compelling urgency. The agency's need is of such an unusual and compelling urgent nature that without the service, the medical healthcare mission will be compromised unless the agency is permitted to limit the number of sources from which it solicits quotes. -Pursuant to FAR Part 5.202(a)(s), Exceptions, the unusual and compelling requirement will not be advertised. -Pursuant to FAR Part 13.106(c)(1), Soliciting competition, price and availability will be obtained telephonically. 5. Reason for Cited Authority: The above statutory authority is cited because this is a true, urgent request that has been verified by COL Joseph M. Paulino Chief, Preoperative Nursing Services and Janet Rindorf on 18 June 2013. The Tornier Affinity total Shoulder implant is needed by 20 June 2013. Not receiving this implant would compromise patient care as the physician has determined the surgery urgent. 6.
