THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6-STREAMLINED PROCEDURES FOR EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS-AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE AND IN ACCORDANCE WITH THE SIMPLIFIED ACQUISITION PROCEDURES AUTHORIZED IN FAR PART 13.5, TEST PROGRAM. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEING REQUESTED, AND A WRITTEN SOLICITATION DOCUMENT WILL NOT BE ISSUED. This solicitation is a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-66, effective April 01, 2013. The associated North American Industrial Classification System (NAICS) code for this procurement is 334516 with a small business size standard of 500 employees. This acquisition is 100% set-aside for small business. 1352.215-72 INQUIRIES (APR 2010) Offerors must submit all questions concerning this solicitation in writing to andrea.parekh@nist.gov Questions should be received no later than 10 calendar days after the issuance date of this solicitation. Any responses to questions will be made in writing, without identification of the questioner, and will be included in an amendment to the solicitation. Even if provided in other form, only the question responses included in the amendment to the solicitation will govern performance of the contract. (End of Provision) Line Item 0001: Quantity one (1) each, Gas Chromatography- Mass Spectrometry Instrument, meeting or exceeding the following minimum requirements. Used or remanufactured equipment will not be considered for award. 1. Mass Spectrometer (MS) a. Scan speed - The scan speed of the instrument must be at least 12,500 u/sec; b. Mass range - The instrument must scan from 2 u - to 1000 u; c. Ion source temperature - Ion source temperature must have the capability to heat up to 300°C; d. The heated quadrupole - The quadrupole must be heated up to 200°C; e. Non-coated source made of a solid material excluding stainless steel; f. Scan increment (step size) - Scanning at the increments of 0.1 u; g. Tune - The Mass Spectrometer must have standard and optional spectra tuning capabilities; "standard tune" means standard response over the entire scan range. h. Oil free foreline pump 2. Gas Chromatograph a. The Gas Chromatograph must offer the capability to install two inlet ports; b. Inlet sealing system must allow for quick easy liner changes without using tools; c. Oven dimensions must be not less than: 25 x 30 x 15 cm and not more than 30 x 35 x 25 cm; d. Oven operating temperature range (+15 °C to 450°C); e. Oven temperature set-point resolution shall be 0.1 °C.g. Split/splitless capillary inlet shall have the split ratio up to 7,500:1, and maximum temperature 400°C capability f.. Must have gas saver mode for the carrier gas. 3. Autosampler a. The autosampler system must be equipped with the Bar Code Reader, Mixer and Heater; b. The autosampler system must have 1. Different types of injection techniques, such as standard, sandwich and multiple injection capabilities, 2. Variable sample vial penetration depth, 3. Variable syringe plunger speed, and 4. Sample preparation capabilities, including dilution, internal standard addition, and 5. Up to 150 sample vials capacity; c. The autosampler system must allow: 1. New sample preparation for injection while current sample is running, 2. Movement from one inlet port to another without manual realignment. 4. Software Software systems for the data analysis compatible with the NIST MS Search system and accessible to AMDIS shall be included. 5. The following must be included as part of the system: a. Computer system The computer system must include a protected and signed BIOS. Processor: IntelCore i7-3770 (8M Cache, 3.4GHz) w/HD4000 Graphics Operating system: "Windows 7 Professional, 64-bit RAM:16.0 GB, DDR3-1600 MHz, NON-ECC, 4 DIMM Storage: RAID1 - two 1 TB disks configured as mirror Optical disk: 16X DVD + /- RW disk. Network cards: two network ports. b. 22-Inch flat panel LCD monitor c. LaserJet printer Black and white Print speed - Up to 42 ppm Networking - Standard (built-in Gigabit Ethernet) Duplexer - Automatic (standard) 6. Safety Features a. The mass spectrometer shall have an automatic interrupt system. In addition, analyzer temperature zone and operating voltages shall be interlocked with vacuum pump speed to prevent instrument damage due to operation at excess pressure. b. The Gas Chromatograph must have (a) a hydrogen safety shutdown system that monitors the hydrogen flow and shuts down the gas flows and heaters if a leak is detected, and (b) an oven explosion protection built into the oven door. The Gas Chromatograph and Mass Spectrometer must have United States and Canadian safety certifications by an accredited agency. Line Item 0002: Installation: The system shall be installed by the contractor and meet contract specifications no later than two weeks after delivery. Installation, at a minimum, shall include uncrating/unpackaging of all equipment, rigging, set-up and hook-up of the system, demonstration of all specifications, and removal of trash. Onsite installation and training shall be done at NIST, Gaithersburg, Maryland. The contractor shall provide samples for on-site demonstration of the performance of the GC-MS instrument for the specifications listed above. Line Item 0003: Training: The contractor shall conduct one (1) training session for up to six (6) technical personnel at NIST. The training shall provide a thorough demonstration of all system/solution functions, maintenance, data administration, and basic troubleshooting. The training may be completed at NIST immediately after installation/set-up and on-site measurements demonstrating that no damage or misalignment issues arose during transportation and installation, but shall be completed no later than 30 days after installation. Warranty: At minimum, the contractor shall warrant the instrument, inclusive of parts and software, for a period of at least one year. Technical support and on-site visits shall be provided as necessary during the warranty period. OPTION LINE ITEMS: The following line item is an Option Line Item. The Contractor shall provide pricing for these items. The pricing shall be effective for five (5) years from the date of award. These Line Items will be evaluated in accordance with FAR 52.217-5 and may be exercised at award or during option period set forth under FAR 52.217-9: Option Line Item 0004: One Year Service Agreement: Period of Performance: One year from the date of Government acceptance. The Contractor shall perform preventive service and repairs for the instrument During this time the contractor shall provide all labor, equipment, consumable supplies, and repair parts for this requirement. The Contractor shall perform the following tasks for the instrument and accessories: Provide a a 48 hour response to an urgent repair. Conduct unlimited, on-demand on-site repair visits to repair instrumentation to an operating condition and minimize downtime. Coverage shall include travel and labor. Provide parts necessary for repairs. Provide consumables/supplies required for repair, including normal wear-and-tear items such as liners, seals, lamps and tubing when needed. Option Line Item 0005: One Year Service Agreement: Period of Performance: Two years from the date of Government acceptance. Provide all services as defined in CLIN 0004 Option Line Item 0006: One Year Service Agreement Period of Performance: Three years from the date of Government acceptance. Provide all services as defined in CLIN 0004 Option Line Item 0007: One Year Service Agreement Period of Performance: Four years from the date of Government acceptance. Provide all services as defined in CLIN 0004 Delivery: Delivery shall be completed within 3 months after the award. Final Acceptance: NIST will provide payment in full upon successful completion of delivery, installation and training, demonstration of all specifications, inspection and acceptance testing, and submission of a proper invoice from the Contractor. Payment terms shall be Net 30 Days. Evaluation Criteria: Award shall be made to the offeror whose quotation is technically acceptable and lowest priced. The Government will evaluate quotations based on the following evaluation criteria: 1. Technical Capability and Price. Price shall be evaluated for reasonableness and evaluated inclusive of any proposed trade-in credit. Technical Capability: Evaluation of Technical Capability shall be based on the documentation provided in the quotation, including data submissions. Technical descriptions and product literature submitted in the quotation shall be evaluated to determine that the proposed instrument meets or exceeds all required specifications listed above. Required Submissions: All quoters shall submit the following: 1). An original and one copy (one if electronic submission) of a price quotation which addresses all line items; 2). For the purpose of technical evaluation quoters shall submit: a. Two copies (one is electronic submission) of technical description and/or product literature which clearly details the manufacturer, make and model of the proposed product(s), addresses all specifications, and clearly documents that the offered product(s) meet(s) or exceeds the minimum requirements listed above. 3). The manufacturer must provide a list of companies that provide accessories for their GC and MS instruments. 4). Acceptance of Terms (Addendum to FAR 52.212-1(b)(11): This is an Open-Market Combined Synopsis/Solicitation for equipment as defined herein. The Government intends to award a Purchase Order as a result of this Combined Synopsis/Solicitation that will include the terms and conditions that are set forth herein. In order to facilitate the award process, ALL quotes shall include a statement regarding the terms and conditions herein as follows: The offeror shall state "The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion, or addition." OR The offeror shall state "The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following: Offeror shall list exception(s) and rationale for the exception(s) Please note that this procurement is not being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant Purchase Order, not the terms and conditions of the offeror's FSS or GWAC contract, and the statement required above shall be included in the quotation. Due Date for Quotations: All quotations shall be sent to the National Institute of Standards and Technology, Acquisition Management Division, Attn: Andrea Parekh, 100 Bureau Drive, Stop 1640, Gaithersburg, MD 20899-1640. Email: Andrea.Parekh@Nist.gov All offerors shall ensure the RFQ number is visible on the outermost packaging. Submission must be received not later than 3:00 p.m. local time on July 12. 2013. FAX quotations shall not be accepted. E-mail quotations shall be accepted. Offerors' quotations shall not be deemed received by the Government until the quotation is entered into the e-mail address inbox set forth above. Because of heightened security, FED-EX, UPS, or similar delivery methods are the preferred method of delivery of quotes. If quotes are hand delivered, delivery shall be made on the actual due date through Gate A, and a 48 hour (excluding weekends and holidays) prior notice shall be provided to Andrea Parekh, Contract Specialist on 301-975-6984. NIST is not responsible for late delivery due to the added security measures. In addition, quoters who do not provide 48-hour notification in order to coordinate entrance to the NIST campus shall assume the risk of not being able to deliver quotes on time. Provisions and Clauses: The full text of a FAR provision or clause may be accessed electronically at www.acqnet.gov/far. The following provisions apply to this acquisition: 52.212-1, Instructions to Offerors - Commercial; 52.212-3, Offeror Representations and Certifications - Commercial Items. Evaluation of options will not obligate the Government to exercise the option(s). (End of Provision 52.217-8 Option to Extend Services The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 5 days from date of expiration. (End of Clause) 52.217-9 Option to Extend the Term of the Contract (a) The Government may extend the term of this contract by written notice to the Contractor within provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 5 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 66 months. (End of Clause) 52.247-34, FOB Destination Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction Under Any Federal Law (Class Deviation) (March 2012) (1) In accordance with Sections 543 and 544 of Public Law 112-55 Commerce, Justice, Science, and Related Agencies Appropriations Act 2012, Title V (General Provisions) none of the funds made available by that Act may be used to enter into a contract with any corporation that- (a) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government. (b) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government.
