- Decision to Create a Set-Aside for Only One Responsible Source 1. Prepared by : The General Services Administration, Public Buildings Service, Greater Southwest Region, Border Service Center. 2. Nature and description of action being approved : Repair the existing concrete pavement by deep injection of a patented polyurethane material process into the soil at Pharr Port of Entry, Pharr, Texas. 3. Description of supplies or services required : Procurement of construction services to repair the existing concrete pavement by injection of a patented polyurethane material process into the soil, this process will lift the concrete panel to their normal position. The application of the proposed product of expanded polymers material will fill, densify and stable low-density compressible soils deep into the sub-soils. This product is formulated to be fast acting and hydro-sensitive, thus ensuring that it is not affected by existing water or wet soils during the injection of the product. The estimated value of this contract inclusive of concrete repair, joint repair is $222,000.00. 4. Identification of statutory authority : Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1. 5. Demonstration that the acquisition requires use of the authority cited : In accordance with FAR 6.302-1, only Uretek USA Inc. will satisfy agency requirements. Uretek’s patented method of polyurethane material has been used on many federal facilities with great success. The Project Manager tried to repair the concrete three years ago without success. They attempted to lift the concrete slabs by pumping a cementuous grout slurry mixture. The concrete panels continue to sink and have become a driving hazardous condition. If repairs are not done soon it could break in the near future and would cost a considerable amount of money to remove and replace these massive panels. The contractor’s unique qualification stands with documentation of Uretek USA’s Inc. as the sole source provider in the USA and its territories for the patented injection process, no other product is available for full and open competition other than a complete removal, re-compaction/treatment of subsoil and replacement to the existing concrete. This process would be very costly. 6. Description of efforts to solicit as many offers as practicable : The decision to reserve this procurement to Uretek USA, Inc was made by the Project Manager and Contracting Officer. The Project Manager recommendation to use Uretek was based upon market research conducted on previously used products that failed in lifting the concrete panels. Mr. Richard Munoz contacted the City of Pharr and Harris County Purchasing Department, and they both praised the services performed by Uretek USA, Inc and highly recommend their patented injection process, Harris County is currently working on Sole Source procurement. The contractor’s unique qualification stands with documentation of Uretek USA’s Inc. as the sole source provider in the USA and its territories for the patented injection process, no other product is available for full and open competition other than a complete removal, re-compaction/treatment of subsoil and replacement to the existing concrete. This process would be very costly. 7. Demonstration that the anticipated cost will be fair and reasonable : The subject contract will be awarded on the basis that the price is determined fair and reasonable when examined by the GSA Contracting Officer, Rosalva Ramos, with consultation from the GSA Project Manager, Richard Munoz. 8. Description of the market survey conducted : A market survey was conducted as stated in number 6 above. 9. Other facts supporting the use of other than full and open competition : Uretek’s patented deep injection process has proven effective on several projects completed successfully for various Government agencies. We are positive that this method will work effectively and will save the Government money in the future. 10. List of sources that expressed an interest in the acquisition : None. 11. Statement of actions to overcome barriers to competition : There are no barriers to competition that need to be overcome; this project is being set aside for one source only as prescribed on FAR 6.302-1. 12. Contracting Officer Certification : The GSA Contracting Officer certifies, by signature below, that the information contained in this justification is accurate and complete to the best of his knowledge and belief. Upon the basis of the foregoing findings, I hereby determine that this project may be set aside for Uretek USA, Inc. Rosalva Ramos, Contracting Officer – 7PQC-MC
