- Sole Source Justification for Simplified Acquisitions - V509542Y This Notice of Intent is NOT a Request for Quotation (RFQ) for competitive quotes; however, in accordance with FAR Part 13 and Part 6.302-1, the Federal Emergency Management Agency (FEMA) intends to award a sole source Blanket Purchase Agreement (BPA) based on the authority of FAR 6.302-1 "only one responsible source and no other supplies or services will satisfy agency requirements". FEMA intends to award this BPA to UNIVAR USA for the purchase of water treatment chemicals. These products are considered commercial items in accordance with FAR Part 2. This action is being performed in accordance with FAR 13.106-1(b)(1) which states, "For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available". A Sole Source Justification for Other Than Full and Open Competition has been approved by the Contracting Officer and is provided as an attachment to this notice. The chemicals to be ordered most often from this proposed BPA are: Sodium Hypochlorite, 12.5% in a 55 gallon drum; DelPAC 2020 in a 55 gallon drum; Carusol 20 in a 55 gallon drum; Chlorine Gas in a 150 pound cylinder; Sulfur Dioxide in a 150 pound cylinder; Powdered Activated Carbon (PAC), 40 pounds. These chemicals are needed in the daily operation of FEMA, MWEOC's Water and Sewer Treatment Plant. While other water chemical distributors can provide one or two chemicals, UNIVAR is capable of providing all the chemicals needed to remove debris, sludge, bacteria and contaminants in the water. Utilizing one vendor to provide MWEOC's water treatment chemicals has been determined to be cost effective, as well as reduces the administrative effort needed to procure these essential chemicals. UNIVAR USA is believed to be the only water treatment chemical distributor capable of providing all the specific chemicals needed to treat MWEOC's water and sewer systems; however, any water treatment chemical distributor capable of providing the required products, is requested to contact Phyllis Woodward via email at Phyllis.Woodward@fema.dhs.gov or by fax to 540-542-2631, no later than July 26, 2013. Capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination not to compete this proposed procurement based on responses to this notice is solely within the discretion of the Government.
