- Description
- The U.S. Department of Energy (DOE), Office of Health, Safety and Security (HSS) intends to award a sole source contract to Air Techniques International (ATI). The requirement consists of pre-operational, independent inspection and testing of High Efficiency Particulate Air (HEPA) filters to verify certain characteristics or properties which will determine acceptance or rejection of that filter. The Contractor must be Nuclear Quality Assurance ? 1 (NQA-1) certified in order to perform this requirement. These services are currently being performed by ATI under Department of Energy Contract Number DE-HS0000003, which will expire on September 30, 2013. The statutory authority for permitting other than full and open competition for this contract is Section 303[c][1] of the Federal Property and Administrative Services Act of 1949, as amended by the Competition in Contracting Act, 41 USC 253[c][1], and implemented by FAR 6.302-1[a][2][ii][B], which authorizes other than f ull and open competition when there is only one responsible source and no other supplies or services will satisfy agency requirements; and when it is likely that an award to any other source may result in unacceptable delays in fulfilling the agency?s requirements. ATI is the only known organization that can provide these independent inspection and testing services for HEPA filters. ATI is uniquely qualified to receive, inspect, test and ship nuclear grade HEPA filters under the stringent quality control applicable to nuclear facilities. ATI has the facility, equipment, qualified personnel and quality assurance program certified to meet NQA-1 nuclear testing standards. This is a notice of intent and not a request for competitive proposals. No solicitation is available for this requirement. If a firm believes that DOE should not pursue this sole source procurement with Air Techniques International (ATI), then they should submit a capability statement and pricing information for the requirement by 12:00pm EST on July 24, 2013. A determination by the Government to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information will be considered solely for the purpose of determining whether to conduct a competitive procurement. The North American Industry Classification System (NAIC) Code for this requirement is 541380. The anticipated period of performance will be for a five years, consisting of a 12-month Base Period and four 12-month Option Periods.
