Description
Justification and Approval 1. Defense Logistics Agency (DLA TSE&A) Troop Support Europe and Africa, Commodities Supply Chain, is the contracting activity. 2. The action being approved is the ability to solicit for DLA TSE&A requirements on an Other than Full and Open competition basis. 3. DLATSE&A's needs to provide Life support for two permanent, and two temporary DLATSE&A Contracting Officer Representatives (CORs) assigned to contractor facilities located in Kabul and Helmand Regional Distribution Center in Afghanistan. This contract will be valid for a period of six month. The estimated dollar value is $134,000.00 4. The applicable statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c) (1), FAR Pati 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. 5. The Supreme Food Service facilities in Kabul and Helmand Regional Distribution Center are the assigned Official Duty Stations of the CORs and are the only facilities in Afghanistan able to provide the required life support, while mitigating risk to U.S. personnel. Due to CENTCOM Force Protection requirements for road travel, it is not feasible for employees to be housed at a neighboring U.S. military facility with Bagram Air Force Base being approximately 35 miles away from Kabul and Camp Leatherneck, while only approximately 5 miles distance from Helmand Regional Distribution Center, is in a continuously volatile area. The CORs would be required to drive with escorted government vehicle from the military facility to Kabul or Helmand Regional Distribution Center and return seven days a week. In addition, it is not practical to house the COR's at a local civilian hotel in Kabul or Helmand Province, as they would still require a daily military escort to and from their duty assignment. There is no reasonable alternative to provide Life Support for the CORs assigned to the Supreme Food Services Contract at this time. This requirement was competed within the Subsistence Prime Vendor contract which will commence performance in December of2013. So while the Government possessed the requisite technical data to evaluate competitive offers there is no offeror in place and able to perform in the interim until the new Vend or is able. It is not practical to house the COR's at a local civilian hotel in Kabul or Helmand Province, as they would still require a daily military escort to and from their duty assignment due to CENTCOM Force Protections for Road Travel. Hotels in these m·eas have also historically been targets for terrorist attacks which would put the CORs in additional and unnecessary danger. There is currently a new Long-Term Contract being put in place by Philadelphia that will replace the current contract which Supreme was previously awarded. The new contract was solicited and awarded based on full and open, unrestricted competition with a successful offeror being awarded June of 2012, followed by the filing of a protest. The new contractor is set to begin performance in December 2013. Until that time, Supreme is continuing to perform on their contract and has the facilities and capabilities to continue providing the required Life Support to the CORs. The requirement of Life Support for the CORs assigned to the Supreme Food Service Contract include but are not limited to Housing - a fully equipped single room with air conditioning and heating, Refrigerator, Desk, Chair, Bed, Mattress, Wall Locker, Internet Access, Television and DVD Player and a private bathroom along with linens, towels and blankets. Subsistence- three meals per day and bottled water at all times, Workspace and all required supplies, communication devices, weekly laundry services, a recreation area and two secure parking spaces. 6. Contract Action is under the Simplified Acquisition Threshold and is unusual and compelling in nature as the contract that has been awarded to provide the CORs with Life Support was delayed by a protest. Not having a continuation of service in place with Supreme Food Services could be detrimental and hazardous to the safety of Government employees whose duty stations are at the facility of Supreme while acting as CORs on the Supreme contract until the new contractor is able to perform in December of2013. In addition, this justification will be made available for public inspection, after award, in accordance with FAR 6.305. 7. As the contracting officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable based on market research of current pricing for comparable accommodations in the same proximity as the vendor's current facilities. Pricing will also be compared to previous prices paid to determine each to be fair and reasonable and in the best interest of the Government. 8. Hotel prices and accommodations were researched through various internet sources. Hotel safety was also reviewed through documentation of various terrorist attacks both on hotels, and in the general area of where the hotels would be located. 9. There is currently a contract in place for Middle East Subsistence that will provide Life Support for the assigned CORs. Due to a protest, the ramp up, and start of performance on this contract was delayed. The current contract with Supreme is still in place enabling the Government to continue housing the CORs at their facilities through a six month contract. The new contractor is expected to be in place and performing with housing capability for the CORs in December of2013 when this contract is set to expire. 10. There are currently no sources expressing interest in this acquisition nor are there any capable of providing the requirement. 11. There should be no requirement for a subsequent acquisition as the long-term contract set to be in place in December was competed with the Life Support of the CORs requirement included. 12.
