- Sole Source Justification Statement of Work The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS), Northeast Fisheries Science Center (NEFSC), intends to negotiate on a sole source basis with Cornell University for maintenance of existing Marine Acoustic Recording Units (MARUs) owned by NOAA, NEFSC. The maintenance shall include refurbishment, raw data extraction, data collection hardware and software upgrades. Period of performance will be September 1, 2013 through August 31, 2015 with three (3) one-year option periods. MARU buoys were custom built for NOAA by the Bioacoustics Research Program (BRP), Cornell Lab of Ornithology, Ithaca, NY. The hardware and software used to build the MARUs require regular upgrades and refurbishment after each in-water deployment and retrieval. BRP has the facilities specifically set up to refurbish the custom built MARU’s. MARU’s are not an off the shelf product and therefore require specialized expertise and capability in order to maintain and upgrade these existing instruments. The Government intends to acquire services using FAR Part 13, Simplified Acquisition Procedures estimated not to exceed $150,000.00. The FSC for this acquisition is J020, the North America Industry Classification System (NAICS) code is 541990 and the business size standard is $7 Million. The contract will result in a firm-fixed price purchase order. The Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements". A Statement of Work (SOW) and sole source justification is attached to this notice. This Special Notice is for informational purposes only and is not a request for competitive proposals. Interested parties may identify their interest and capability by responding to this requirement or submitting a capabilities statement containing sufficient detail to determine if the party can meet all of the foregoing requirements. Any responses or questions concerning this Notice of Intent shall be submitted via email to Kelly Taranto at kelly.taranto@noaa.gov. Responses are due no later than July 22, 2013, 4:00 PM local time. All correspondence must reference NFFM7320-13-02850. A determination by the Government not to compete this requirement based upon responses to this notice is solely within the discretion of the Government. It is the Government's belief that only Cornell Lab of Ornithology can provide these services.
