- CANCELLATION NOTICE:This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.The solicitation number is 0040074883-03 and is issued as an invitation for bids (IFB), unless otherwise indicated herein.The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-66. The associated North American Industrial Classification System (NAICS) code for this procurement is 423810 with a small business size standard of 100.00 employees.This requirement is unrestricted and only qualified offerors may submit bids.The solicitation pricing on www.FedBid.com will start on the date this solicitation is posted and will end on 2013-06-19 11:00:00.0 Eastern Time or as otherwise displayed at www.FedBid.com.FOB Destination shall be Muskogee, OK 74402 The DOI BIA - Western Region requires the following items, Meet or Exceed, to the following: LI 001: The Bureau of Indian Affairs requires a Compact Track Loader. The Compact Track loader MUST: 1.) Have a Rated Operating Load of a minimum of 1,100 Ibs. to a maximum of 2,000 Ibs.; 2.) Have a Diesel Engine; 3.) Have a quick connect system so the operator isn't required to exit the driver?s seat to switch attachments; 4.) Minimal pallet forks of 54 inches; 5.) 72 inch Heavy Duty Bucket; 6.) 2 Year comprehensive warranty (if not comprehensive, please send warranty details) and the warranty work must be done within 65 miles of Muskogee, OK; 7.) Be a 2011 or newer compact track loader with a maximum of 1000 hours use. The machine must have a certified inspection by the manaufacturer. The compact track loader must also have new rubber tracks (installed within 100 hours of total use) and valid proof must be submitted showing when the tracks were purchased and installed. These are the minimal "essential characteristics" of this requested compact track loader and the evaluation process will take the responsiveness to the essential characteristics, the Fedbid performance history and CPARS history, and the lowest price when determining the winner. ******************** There's another Fedbid solicitation (0040074883-02, Fedbid # 493271) that will be posted. This other solicitation is for the same requirement, but it's requesting bids for the same essential characteristics, but it's for a "new" item of supply. Please visit that solicitation for details and the opportunity to bid on that solicitation. There will be only one purchase made (either from that solicitation or this one, but not both). The program and contract specialist will evaluate each solicitation independently, based on the evaluation factors listed. The program person and the contract specialist will then determine which winner of each solicitation will be the overall winner, based on the government?s best interest. ********************************, 1, EA; Solicitation and Buy Attachments ***Question Submission: Interested offerors must submit any questions concerning the solicitation at the earliest time possible to enable the Buyer to respond. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** For this solicitation, DOI BIA - Western Region intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. An Offeror may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. DOI BIA - Western Region is taking this action in an effort to improve both vendor access and awareness of requests and the agency's ability to gather multiple, competed, real-time bids.All responsible Offerors that respond to this solicitation MUST submit the pricing portion of their bid using the online exchange located at www.FedBid.com. There is no cost to register, review procurement data or make a bid on www.FedBid.com.Offerors that are not currently registered to use www.FedBid.com should proceed to www.FedBid.com to complete their free registration. Shipping must be free on board (FOB) destination CONUS (Continental U.S.), which means that the seller must deliver the goods on its conveyance at the destination specified by the buyer, and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination. This solicitation requires registration with the System for Award Management (SAM) prior to award, pursuant to applicable regulations and guidelines. The selected Offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items - the selected offeror must submit a completed copy of the listed representations and certifications; FAR 52.212-4, Contract Terms and Conditions - Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, paragraph (a) and the following clauses in paragraph (b): 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13, 52.232-34. Offerors must be registered in Online Representation & Certification Application (ORCA) https://orca.bpn.gov/ at the time of proposal submittal It has been determined, based on market research, that there's not a small business that manufactures/produces this item of supply. Thus, under small business rules, the item isn't sat aside for small businesses. If this is incorrect, please notify the contract specialist with all the details of the small business and the product that would be responsive to this solicitation. After the point of verification of two small businesses ability to manufacture/produce this item, the contract officer will cancel the solicitation and re-solicit it under a small business set-aside. Also, it has been determined via market research that there's not a Indian Economic Enterprise (IEE) that produces/manufacturers this item of supply and this item of supply isn't being sat aside under the Buy Indian Act. As stated above, if this is incorrect, please notify the contract specialist with all relevant data and it the solicitation will be re-solicited under the Buy Indian Act.
