- A. Description: 1. This is a Combined Synopsis and Solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; therefore, quotes are being requested and a written solicitation will not be issued. 2. The solicitation number is CSS3009872 and the solicitation is issued as a request for quotation. 3. This acquisition is for a commercial and is conducted under the authority of the FAR Part 13-Simplified Acquisition Procedures and the FAR Part 12-Acquisition of Commercial Items and is not expected to exceed the simplified acquisition threshold. 4. The solicitation document and incorporated provisions and clauses are those in effect through the Federal Acquisition Circular (FAC) 2005-68 effective June 26, 2013. The resultant purchase order will include all applicable provisions and clauses in effect through the FAC 2005-68 effective June 26, 2013. 5. This solicitation is a 100% Full-and-Open Competition. The intended procurement is classified under North American Industry Classification System Code 334516 with a Size Standard of 500 employees. 6. Service Maintenance for Bruker Biospin 4.7T Magnet which does not void the manufacturer's (Bruker's) warranty. 7. The contractor shall perform according to the Statement of Work as follows: a. Provide telephone support for diagnosis of covered equipment malfunction(s). This support will be provided during the hours 9:00 A.M. and 5:30 P.M. Eastern Standard Time Monday through Friday, excluding Federal Holidays. b. Provide replacement parts as required on an exchange (refurbished) or new part basis, at the Government's discretion. All parts are warranted for 90 days after installation. c. Provide material for engineering changes that we develop and determine to be appropriate for the instrument. d. For covered equipment malfunction(s), provide software updates for Bruker applications software required to operate the covered equipment, as Bruker releases these updates. e. Software updates apply only to formally licensed Bruker applications software used to operate covered equipment. Software "bugs" in the applications software will be corrected in the next update release. f. Software defects or other significant problems shall be corrected as soon as possible. g. When a service call is initiated by the Government, the contractor shall contact the Government's lab to gain a more complete understanding of the problem, recommend diagnostic tests and, interpret the results with the Government. h. If the diagnostics indicate that material is required, the contractor shall arrange for overnight shipment. i. The contractor shall contact our lab to determine the status of the instrument. j. If the replacement material resolved the problem, the defective material shall be returned to Bruker using shipping information and pre-paid labels included with the repair items. Upon receipt of the defective material, the dispatch shall be closed. k. If the replacement material did not resolve the problem, the contractor shall together with the Government's lab, mutually determine the best next step. 8. The period of performance: 8/31/2013 through 8/30/2014. The place of performance: The National Institutes of Health Campus; 49 Convent Drive; Building 49; Silvio O. Conte Building; Bethesda, MD 20814. 9. The provision at the FAR clause 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition. 10. The provision at the FAR clause 52.212-2, Evaluation - Commercial Items, if used, applies to this acquisition. The Government's evaluation procedure will be based on the ‘Lowest Priced-Technically Acceptable'. Therefore, the quote which offers the technically acceptable and lowest priced solution to the Government's requirements will be evaluated to be the ‘Best Value' to the Government. 11. The provision at the FAR clause 52.212-3, Offeror Representations and Certifications - Commercial Items, applies to this acquisition. An offeror must include a completed copy of the provision at the FAR clause 52.212-3, Offeror Representations and Certifications - Commercial Items, with its offer. 12. The provision at the FAR clause at 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. 13. The provision at FAR clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. 14.
