652-13-4-164-0153 DEPARTMENT OF VETERANS AFFAIRS VISN6 Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: The VISN 6 Centralized Acquisition Service of the Department of Veterans Affairs, Richmond VAMC intends to execute a Justification and Approval for Other than Full and Open Competition. 652-13-4-164-0153 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for the procurement of a HVAD Pump Implant Kit Stock# 5400 from Heartware Inc. 3.Description of Supplies/Services Required to Meet the Agency's Needs: A HVAD Pump Implant Kit is a HVAD Pump Implant Kit to be used in an emergency heart procedure scheduled for 7-22-13. This kit is engineered specifically for heart surgery and to enhance Outflow graft. The delivery date for this item was 22 July 2013 by 8:00 AM for an emergency procedure at 8:30 AM. $123,325.00 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §253(g), as implemented by FAR 6.3 02 (2). ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This was an emergency order received at 3:15 PM and needed for the next business day patient emergency heart surgery at 8:30 AM. Heartware was able to provide delivery by 8:00 AM the next business day. FAR 6.302-2(2)(b)(2) 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: No additional sources where researched due to the emergency order and short delivery requirement. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: A search of the Medical Surgical Catalog on the NAC, identified a similar items by Stealth Surgical but the vendor could not provide all the items in due time for scheduled and prices were much higher. Therefore the items are found to be fair and reasonable based on price. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: No additional Market research was conducted. This was an emergency order received at 3:15 PM and needed for a patient for 8:30AM the next business day. Heartware Inc. was able to delivery this emergency order by 8:00 AM the next business day. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: All supporting facts are listed above. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Heartware Inc. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: To prevent future emergency orders the requesting office could purchase HVAD Pump Implant Kit and maintain a stock
