- . Contracting Activity: Department of the Navy, Military Sealift Command-Norfolk (MSC), 471 East C. Street Norfolk, Va. 23511. 2. Description of Action Being Approved: MSC Norfolk has a requirement to procure Long Lead Time Material for future repairs to the #3 Cargo Holds of the USNS MEDGAR EVERS and USNS CESAR CHAVEZ. 3. Description of Supplies/Services: This requirement covers the sole source procurement of Long Lead Time Insulation Materials that will be used onboard the USNS MEDGAR EVERS and USNS CESAR CHAVEZ during repairs to the 3# Cargo Hold Overhead on all three decks. Parts will be delivered prior to the end of the fiscal year. 4. Statutory Authority Permitting Other Than Full and Open Competition: The statutory authority for this procurement is the test program for commercial items (Section 4202 of the Clinger Cohen Act of 1996) implemented at FAR 13.501. 5. Rationale Justifying Use of cited Statutory Authority: The T-AKE class vessel cargo holds were deficiently designed with three inch (3") fiberglass insulation. This cargo hold is designed to hold frozen and refrigerated goods. MSC developed a Transalt to address this deficiency which requires installation of six inch (6") foam insulation. The Transalt was accomplished on T-AKE 1 through 11 during their Post Shakedown Availabilities (PSA's). Thermcor was involved with the Transalt accomplishment on T-AKE 1 through 11 either as the prime contractor or a shipyard subcontractor. Thermcor is the only known company that can meet the form, fit and function of the approved Transalt. Additionally, Thermcor can meet the required delivery date. 6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The requirement was synopsized in FEDBIZOPPS on 21 June 2013. To date there has been only one small business that has replied to the posting. 7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine that the price is fair and reasonable pursuant to Federal Acquisition Regulations (FAR) Part 13.106-3. 8. Actions to Remove Barriers to Future Competition: For reasons set forth in paragraph 5, MSC has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, MSC will assess whether competition is feasible at that time.
