Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The combined synopsis/ solicitation number is W91ZLK-13-T-0235. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 05-60. This requirement is a Total Small Business Set Aside. The associated North America Industry Classification System (NAICS) Code is 541890 and the Business Size Standard is 7.0. The Government contemplates award of a Firm-Fixed Price (FFP) Purchase Order. In accordance with the specifications, using Federal Acquisition Regulation FAR PART 13.5, Test Program for Certain Commercial Items. Acceptance shall be at destination listed on Statement of Work. Located at Aberdeen Proving Ground, Maryland 21005. Description of the Requirement: 50 Weekly issues of the APG News published and distributed to various locations in accordance with the distribution list on the statement of work on Aberdeen Proving Ground. The selected contractor shall publish and distribute the newspaper without charge to the military and civilian personnel. The period of performance is to begin 30 August 2013 through 29 August 2013. The following is a detailed Statement of Work: STATEMENT OF WORK 1.APG NEWS a.The name of the publication resulting from this contract will be APG NEWS and said name will remain the property of the agency. Said name will not be subject to registration as a trademark by the contractor. The use of said name is for the contractor's exclusive use. This contract requires the successful offeror to publish a newspaper and post an electronic version of it on the Internet. The Contractor has no authority to permit or authorize other firms or persons to use said name. See Department of Defense Instruction 5120.4, Enclosure 4, paragraph E4.1.3 b.The masthead of each issue of the newspaper will include the name and telephone number of the Garrison Aberdeen Proving Ground Public Affairs Office (PAO), the name of the Contractor, the frequency of publication, method of reproduction and circulation. c.The Flag of each issue will include the following statement: Published in the interest of the people of Aberdeen Proving Ground, Maryland. d.The newspaper will print the following disclaimer in 8-point bold or 10-point type: quote mark The APG News is printed by (name of publisher), a private firm (or individual), in no way connected with the Department of the Army, under exclusive written contract with APG... The appearance of advertising in this publication, including inserts or supplements, does not constitute endorsement by the Department of the Army or (name of publisher) of the products or services advertised. e. Any statement, which implies that the newspaper is an official publication of the Department of the Army, is prohibited. Official Department of the Army seals, insignia, or emblems may not be used in the flag or masthead. 2.DISTRIBUTION: The Contractor shall publish and distribute the newspaper without charge to the military and civilian personnel of Aberdeen Proving Ground and shall distribute the newspaper in the following manner: a.The Contractor shall distribute weekly copies of the APG NEWS as required. The number of newspapers to be delivered each week is subject to change by the Contracting Officer or Contracting Office Representative (COR) when necessitated by significant increases or decreases of personnel at the installation. Such increases or decreases shall not exceed forty (40) percent, unless previously agreed to by both parties of this contract, except as noted in paragraph below. b.The Contractor agrees to distribute copies of the APG News to various other points at Aberdeen Proving Ground in accordance with the distribution list furnished and periodically updated by the PAO. Delivery to the Post Exchange (PX), commissary, Express stores (shoppettes), bowling center and recreation centers will be made after 10 a.m. so that the newsstands inside each establishment can be serviced. Delivery to these locations will be completed by 2 p.m. c.A minimum of 50 issues per year will be published on Wednesday and distributed no later than close of business the following day. When the publication date falls on a holiday, the newspaper will be published the day prior to the holiday. The Government will provide the Contractor with a list of recognized holidays upon awarding of the contract. d.The Contractor shall provide sufficient paper stock for selection by the Government prior to the time of initial printing. As a minimum paper stock will be 30 lb newsprint and off-white stock. The Contractor shall provide four color processing and spot color, as requested. e.Fifty copies of the APG News will be delivered to the PAO no later than noon the day of publication. f.Contractor will deliver a copy of each week's newspaper to each set of Family quarters on APG no later than 6 p.m. the day of publication. g.The Contractor shall ensure insertion of special publications, safety pamphlets or brochures, Army Community Services/Quality of Life materials or other similar materials concerning on-post agencies or activities in to the editions of the APG news that are delivered to Family residences at both areas of the proving ground. h.The Contractor shall provide news stands in the number needed and requested by the Contracting Officer. The stands shall be labeled quote mark APG News quote mark for the display of the newspaper. The Contractor agrees to replace or repair any damaged, destroyed or missing newsstands. Newsstands should, at a minimum be placed at the following locations: Post Exchanges, Burger King, Donna's Pit Beef, Commissary, Bowling Center, gymnasium and recreation centers, C4ISR complex, Garrison Headquarters Bldg. 305, health and dental clinics, Express stores and the Thrift Shop. i.The Contractor agrees to place all papers with the front page facing up in the newsstands. Contractor will remove all previous issues. The Contractor agrees to bring any distribution problems to the attention of the Government for resolution between the two parties. j.The Contractor agrees to mail free copies of the newspaper each week to the designated number of U.S. Army Units and Army Components. The Contractor agrees to make the newspaper available by subscription to such members of the public who may desire to subscribe by mail and the Contractor r may charge a reasonable fee for mailing or handling of subscriptions authorized by the PAO. No profit from this activity will be realized by the printer. The cost of mailing shall only cover postage. All requests will be approved by the PAO. k.Requests from foreign countries or their embassies for delivery of the newspaper will be forwarded to the post Public Affairs Office for necessary action in accordance with applicable Army regulations. l.Contractor shall have two CDROM/DVD copies made of all issues of the newspaper and provide two copies of each CDROM/DVD to the Garrison Public Affairs Office (PAO) without charge. The Contractor shall have made a bound volume containing a paper copy of each published during the performance of this contract and provide it without charge to the PAO. m.The Contractor shall make available professional development, as needed, to the contract staff. This includes training in photography, interview techniques, layout & design, and editing. The Contractor shall schedule for the contract staff quarterly, face-to-face quote mark health & welfare quote mark meeting with supervisor(s). n.The Contractor shall protect all copies of newspaper with plastic whenever newspapers are distributed on Aberdeen Proving Ground during inclement weather, specifically rain or snow. o.If the Contractor does not comply with the provisions of this contract, the Publisher has the authority and responsibility to prohibit distribution of any issue of the publication. The Publisher agrees to notify the Contractor, no later than 3 p.m. the day prior to publication, of a decision to exercise this right. 3.CONTENT RESTRICTIONS: If the publisher prints the issue containing the objectionable advertisement(s), the commander may prohibit distribution in accordance with DoD Directive 1325.6 (reference (u)). See Department of Defense Instruction 5120.4, Enclosure 4, paragraph E2.1.2.1. & E4.1.7.4. POLITICAL NEWS a.Cartoons, news and editorials pertaining to political campaigns will not be carried in the printed or electronic newspaper, with the exception of balanced impartial news summaries provided by commercial newsgathering wire service where authority exists to use such services. b.No opinion poll, survey or straw vote relating to a political campaign, candidates, or issues will be conducted. ADVERTISING a.A minimum of four pages will be kept free of advertising with an option for a fifth page, if needed. These will include pages 1, 2 and 11 as standard, in addition to the two briefs pages and classifieds. PAO will notify the Contractor by Thursday of publication week if a doubletruck (center spread) is needed for editorial space. These requirements may be changed upon the direction of the Contracting Officer or COR. b.The newspaper will not carry any advertisements that imply discrimination toward any person because of handicap, marital status, religion, race, national origin, color, creed, or sex. Advertisements will not be accepted from advertisers practicing such discrimination even if the advertisements do not imply it. Each newspaper will notify its reader and advertisers of this requirement by including in a prominent location in 8-point bold or 10-point type the following: Everything advertised in this publication shall be made available for purchase, use or patronage without regard to race, color, religion, sex, national origin, age, marital status, physical handicap, physical affiliation or any other non-merit factor of the purchaser, user or patron. A confirmed violation of rejection of this policy of equal opportunity by an advertiser, the printer shall refuse to print advertising from that source. c.Advertisement for off-post housing available for rent, sale or lease by an owner, manager, rental agency, agent or individual will include only those available on a nondiscriminatory basis for all personnel. No facilities will be advertised without the Contractor having been notified that the owner, manager, rental agency, agent or individual enforces opening housing practices. d.The Contractor shall adhere to Department of the Army policy that commercial businesses soliciting military personnel through advertising appearing in CE publications be ethical in describing goods, services, commodities, and the terms of the sale (including guarantees and warranties). If credit terms are offered in such advertisements, a clear statement of the total cost of cash price, as well as the total costs of credit, including all charges, will be shown clearly in the company's advertisements. If time payments are shown, the number of payments, the amount of each, and the time period will also be shown so that the reader can easily compute the dollar cost of the loan. e.The Contractor agrees to carry the following disclaimer near real estate advertising in the newspaper's classified section: quote mark All real estate advertised in this newspaper is subject to the Federal Fair Housing Act of 1968, which makes it illegal to advertise any preference, limitation, or discrimination based on race, color, religion, or national origin, or an intention to make such preference, limitation or discrimination. The APG NEWS will not knowingly accept any advertisement for real estate that is in violation of the law. Our readers are hereby informed that all dwellings advertised in this newspaper are available on an equal opportunity basis. quote mark f.The Contractor agrees to furnish to the Contracting Officer Representative one hundred percent (100) of the complete advertising page dummies no later than 10 a.m. Monday prior to the date of publication. The Contractor agrees to replace any ads killed after 10:00 a.m. Tuesday with appropriate filler material, and further agrees not to accept any new ads for that week's issue after that time. When holidays occur affecting the make-up or distribution deadlines contained herein, the Contractor shall adjust the delivery date accordingly. The Contractor shall assume full responsibility for filling all space set aside on the dummies for advertising. In the event tentative advertising does not materialize, the Contractor will fill the space with house advertising and the space will not be counted as editorial space. g.If a manifest system is used, the receipt of late advertisements received after the editor submits the manifest will not displace stories listed on the manifest by the editor. If manifested ads are not received, the Contractor will fill the space with house advertising and the space will not be counted as editorial space. If manifested ads arrive in a different size than expected, adjustments will not be made at the expense of editorial copy without the consent of the Contracting Officer. h.Neither the Contractor nor the COR shall solicit advertising in the name of Aberdeen Proving Ground or the United States Army. The Contracting Officer or COR will provide the Contractor or his or her representative(s) a Letter of Authorization to be shown to potential advertisers to establish the relationship between the newspaper and the publishing firm. i.The Contractor agrees not to accept any advertisements for bingo games or lotteries conducted by commercial organizations whose primary business is conducting lotteries or bingo games. 4.CONTRACTOR-FURNISHED ITEMS AND SERVICES a.The government shall provide office space collocated with the PAO. The contractor shall furnish and update all necessary supplies, repair parts, materials, tools and support equipment to meet contractual requirements. In the event of PAO's relocation, the contractor shall be provided space in the new location. Movement of contract personnel and equipment (which includes: to disconnect, move, arrange for transfer of supporting telephone service without interruption or delay to the newspaper operations, and reinstall equipment and supplies) shall be at the expense of the contractor. All the expenses incurred throughout this paragraph will be at no cost to the government. b.The contractor shall provide a selection of varied styles of headline types and various styles of text (body) types on a weekly basis. (Headline styles in sizes 6 point through 72 point, with capability for larger sizes as required, and text sizes from 6 to 24 point) c.The contractor shall provide an electronic (online proofs) for review each week for the APG NEWS when, for exceptional reasons, layout cannot be done within the public affairs office. Proofs will be provided in Adobe.pdf format, unless prior coordination with Contracting Officer or COR allows for other electronic format. d.The contractor shall be responsible for providing and maintaining its own copier services at the PAO. The contractor shall provide copier services at the PAO which shall include a minimum copy capability of 11 quote mark x 17 quote mark with minimum reduction ratios of 64-100% and minimum enlargement ratios of 101-141%. The contractor shall be responsible for the transportation, installation, maintenance, and repair of all such equipment. e.The contractor must utilize a desktop publishing system, to include all software and hardware, that is compatible with existing and future PAO computer equipments. The contractor shall maintain network laser printing capability which is capable of connecting the PAO newspaper office with the contractor's facility. The contractor must utilize a desktop publishing system to include all software and hardware that is up to industry standard. f.The contractor shall provide a post office box or other mailing address specifically for APG NEWS advertising bypassing PAO. The contractor shall provide services on the installation to collect the APG NEWS advertising to appear in the following week's newspaper. The contractor shall also publish a telephone number in the APG NEWS advertising section of the newspaper for inquiries about APG NEWS advertising. The PAO will not accept APG NEWS advertising. g.Contractor will provide four 8-page color supplements annually at the same page-size as the newspaper at no cost to the government. Contractor-managed advertising will comprise no more than 30% of each supplement. h.Special editions of the APG News may be printed either in addition to or in lieu of the weekly edition of the newspaper. The size and content of such special editions shall be subject to the mutual agreement of the parties. It is understood that all terms and conditions of this contract shall apply to such special editions. Publication of special issues will be subject to the maximum amount of advance notice to the Contractor is possible, but not less than two calendar weeks. The Contractor shall furnish a proofed and ready Harford County bus schedule one week prior to publication for the start of the school year. i.The APG News will not be distributed either as a supplement or insert to any privately produced civilian newspaper or periodical. Privately produced newspapers or publications may not be distributed as inserts to the APG News. j.The contractor shall post APG NEWS newspaper online adhering to Department of the Army security guidelines. The first online edition shall be posted by the contractor on or one day following publication of the contractor's first print edition. Electronic posting is financed entirely by the contractor (no use of appropriated funds will be used.) If advertisements are included on the site, the advertisements will take up no more than 20% of screen space; the Contractor will adhere to the same rules for online advertisement as for the print version (para. 3 above); and each page will include the following disclaimer: quote mark The appearance of advertising on this Web page does not imply endorsement by the U.S. Army or the Department of Defense. quote mark 5. PERSONNEL The contractor and its personnel shall act and operate in accordance therewith. Department of Defense Instruction 5120.4, Enclosure 4, paragraph E.4.1.5. a.Contract Manager: The Contractor shall provide a Contract Manager who shall be responsible for the performance of the work. The name of this person and alternate(s), who shall act for the Contractor when the manager is absent, shall be designated in writing to the Contracting Officer or the Authorized Government Representative (AGR) within fifteen (15) days after contract award. b.The Contract Manager or alternate(s) shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract. c.The Contract Manager or alternate(s) shall be available during normal duty hours within two (2) hours to meet on the Installation with the government personnel designated by the Contracting Officer to discuss problem areas. Transportation to and from the installation at all times is the responsibility of the Contractor. After normal duty hours, the Contract Manager or designated alternate(s) shall be available by telephone within three (3) hours. d.Contractor will provide staffing at a level sufficient to fulfill content requirements for the APG NEWS. A sufficient staffing level includes 2 staff writers, 1 writer/editor, 1 photographer, and 1 person to do page layouts (also known as the contract staff). If no full-time photographer is assigned to the APG NEWS, the Contractor will develop procedures to ensure timely support of the photographic requirements as determined by PAO. The procedures will ensure photographic support is provided given the following advance notification by PAO: 1) 1-2 days for routine matters 2) 1-hour notice for breaking news events e.The Contractor shall furnish alternate reporters and designers for any absences, and shall reimburse reporters and designers for any expenses incurred to perform duties relating to the publication of the APG NEWS. The Contractor will obtain feedback from the Contracting Officer, COR or Government personnel in order to provide reasonable evaluations for the staff writers, writer/editor, photographer and paginator/designer. f.Contractor will ensure photographers use photographic equipment and imaging software that meets industry standard. Photographers are expected to provide finished photos on the same day as events. Photographers are expected to provide weekend and after duty hours service. g.All photos taken in support of the APG NEWS, including photos not used in the newspaper, become property of the Department of the Army, Aberdeen Proving Ground. Photographers will provide photos to Contracting Officer or COR on CD-ROM or DVD format at least once per week. 6.LIABILITY: This newspaper is to be published and distributed by the Contractor. The Agency will not be responsible for the debts that may be incurred in the publication and distribution of such newspaper nor shall the agency be responsible for any editorial matter produced by the Contractor and published in such newspaper. The Contractor specifically agrees to hold harmless the United States of America, the Department of Defense, the Department of the Army, the Installation Commander, and the Installation from and against any and all claims, demands, transactions, debts, liabilities, judgments, and costs arising out of, claimed on account of, or in any manner predicated upon loss or damage as a result of the publication or distribution of said newspaper. 7.Each issue of the APG NEWS will have a minimum of 12 editorial pages and a maximum 36 editorial pages and be comprised of 60% editorial content. The PAO shall be responsible for providing all of the written editorial content as needed. 8.ADHERENCE TO LAWS AND REGULATIONS: This contract is subject to Department of the Army regulations and is intended to conform in all respects with the principles and policies of the Department of the Army or its agencies. Specifically, the Contractor shall ensure that copyright and libel laws are not violated; and that the spirit of the Army Regulation 210-1, AR 360-1 and DOD Directive 5120.4 is maintained. 9.STANDARD DEFINITIONS: a.Contracting Officer-A personal duly appointed with the authority to enter into and administer contracts on behalf of the Government. b.Contracting Officer Representative (COR)-An individual designated in writing by the Contracting Officer to perform specific contract administrative functions. The COR does not have the authority to enter into or change the contract. The COR functions will be delegated in his/her appointment letter. c.Civilian Enterprise Letter-Newspaper printed and distributed by civilian printers under contract with Army components or their subordinate commands. The news and editorial content are approved and provided by the Public Affairs Office. These newspapers contain advertising sold by the civilian printers and may include supplements or inserts. They become the property of the command, installation or intended recipient upon delivery in accordance with the terms of the contract. d.Publisher-Commanding Officer of Aberdeen Proving Ground or designee. e.Contractor-the civilian printer of the newspaper. CLIN 0001 APG News (no-cost) contract The following provisions and clauses will be incorporated by reference: 52.209-6 Protecting the Government's Interest when Subcontracting with Contractors Debarred, Suspended or Proposed for Debarment 52.212-1 Instruction to Offerors Commercial Items 52.212-2, Evaluation Commercial Items The Government will award a firm fixed price purchase order based on the lowest price technically acceptable LPTA to the Government. All offered items must meet the specifications of the proposed applicable item or the offer will be rejected as technically unacceptable. A technically acceptable offer is required to fully meet all the specifications. The technical evaluation will be a determination based on information furnished by the vendor. The Government is not responsible for locating or securing any information which is not identified in the offer. The Government reserves the right to make an award without discussions. The Government reserves the right to award on all or none basis. 52.212-3, Offerors Representations and Certifications Commercial Items An offeror shall complete only paragraph (l) of this provision if the offeror has completed the annual representations and certifications electronically at http://orca.bpn.gov.
