ATTACHMENT A JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for a 12 month firm-fixed price (FFP) effort issued as a 100% small business set-aside under the Federal Business Opportunities (FBO) website for the procurement of six additional brand name FaxBack Enterprise Fax Port Licenses and software support for Department of Veterans Affairs (VA), Veterans Health Administration (VHA), Department of Research & Development, West Haven Cooperative Studies Program Coordinating Center (WH-CSPCC). 3. Description of Supplies or Services: The purpose of the effort is to procure six additional brand name FaxBack Enterprise Fax Port Licenses and software support. The software support is required to maintain the Fax Port licenses currently installed in the FaxBack Dell Fax Server supporting CSPCC studies. The 12 month annual Fax Port license software support shall include technical support from 6:30am to 5:00 pm M-F; except federal holidays, online knowledge base access, software and firmware updates. 4. Statutory Authority: The statutory authority permitting other than full and open competition is 41 U.S.C.3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1(c) entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements - Application for brand-name descriptions." 5. Rationale Supporting Use of Authority Cited Above: This is a brand name justification in support of FAR 11.105, Items Peculiar to One Manufacturer. VA does not possess the proprietary technical data required to maintain and upgrade the FaxBack Fax Port licenses that has been in use by VA for several years in support of the WH-CSPCC, as such, its utility and effectiveness has been proven. Fax Port license software is in use within WH-CSPCC in support of multi-site clinical research studies. The Fax Port software is a foundational component that enables WH-CSPCC to accurately collect patient data; as this data collection is critical to maintain patient safety. Failure to acquire the aforementioned licenses and maintenance support services would mean that VA would be without the certified response support needed if/when system failures occur. The procurement of a new Fax Port server software solution rather than procurement of additional licenses and support for the current FaxBack Fax Port licenses would result in substantial duplication of costs that would not be recovered through a new competitive acquisition. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. Limited competition is anticipated for this acquisition. Additionally, the proposed action will be synopsized on the Federal Business Opportunities Page in accordance with FAR 5.201. Any proposals that are received shall be evaluated. 7. Actions to Increase Competition: All future requirements will be handled on a case-by-case basis to determine any future acquisition strategy. 8. Market Research: VA's Technical expert reviewed two other fax port licenses; however, it was determined that neither of the two products: Fax Server AX-FS-V8 with FaxAgent Appliance licenses from Axacore and NetVanta Unified Communications Server Fax Port Expansion License from Adtran could seamlessly integrate into the existing VA solution. Axacore Fax Server is a stand alone product, not an add-on to the existing VA's FaxBack solution. Unlike FaxBack, Axacore's product does not support routing fax images to a network shared drive and this feature is a critical requirement for VA's fax server solution. The Adtran product is also a stand along product and is not appropriate as a replacement for our existing FaxBack solution as it is not a Fax Server. In June 2013, VA's technical expert conducted market research on National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) utilizing the Manufacture Lookup Tool for FaxBack, Inc. and Product Verification Tool. The results revealed one large business reseller in Group D Value Added Resellers (VARs) for this product. The Product Verification search revealed that the FaxBack Fax Port Licenses were not listed on the reseller's product list. Furthermore, on June 25, 2013, the Technology Acquisition Center (TAC) issued a Request for Information (RFI) number VA118-13-I-0433 on the Federal Business Opportunities (FBO) website. On June 28, 2013 the RFI closed and only one small business responded to the RFI indicating it was an authorized FaxBack reseller capable of meeting VA's needs. Additional research was conducted by searching the General Services Administration (GSA) Schedule 70 contract holders; the search revealed a capable small business as well. In view of the above, a Request for Quote will be solicited as a 100% small business set-aside on FBO website. 9. Other Facts: None.
