- FAR 8.405-6 Limited Sources Justification The acquisition is conducted under the authority of the Multiple-Award Schedule Program (i) United States Department of Agriculture; Animal and Plant Health Inspection Services; Marketing Regulatory and Business Services; Administrative Services Division; Minneapolis Procurement Office FAR 8.405-6 Limited Sources Justification (ii) Limited Sources justification to extend current Asian Longhorned Beetle (ALB) ground survey task order (AG-6395-D-11-0579) from 31 July 2013 through 31 August 2013 including the addition of 1,082 acres to survey worth approximately $525,000. (iii) ALB ground survey work in support of the ALB eradication program in Worcester, MA (iv) In accordance with FAR 8.405-6 (a) (1) (i) (C) this is a logical follow-on to an original Federal Supply Schedule order that was competitively placed in accordance with applicable Federal Supply Schedule ordering procedures. Davey Tree Expert Company is currently conducting ALB survey work in Worcester, MA. (v) The order represents the best value to the Government (vi) The second phase of survey work (2013-2016) is currently under solicitation AG-6395-S-13-0074 which closed on 23 July 2013 with a contract performance start date of 31 August 2013. Multiple companies responded to the solicitation so adequate competition exists. (vii) Due to weather delays, funding problems and other factors (internal and external) the current ALB MA survey solicitation did not close in time for an award to be made before for the next survey cycle. In order to keep continuity, allow the current surveyors to stay employed (see clause 52.222-17 Nondisplacement of Qualified Workers), and keep a workforce with skills necessary to conduct beetle surveys it is in the best interest of the Government to continue survey work until a new contract is in place. In addition the Asian Longhorned Beetle outbreak is a Secretary of Agriculture declared emergency (i.e., an urgent and compelling need exists and a delay could cause additional financial harm to the United States). (viii) No additional actions are necessary to overcome barriers to the restricted consideration because the current solicitation shows adequate competition. We just cannot get to an award before the current survey contract ends. (ix) This justification is accurate and complete to the best of the contracting officer's knowledge and belief (x) na (xi) For a proposed order or BPA with an estimated value exceeding the simplified acquisition threshold, but not exceeding $650,000, the ordering activity contracting officer's certification that the justification is accurate and complete to the best of the ordering activity contracting officer's knowledge and belief will serve as approval Prepared By: Nathan Johnson Approved By: James Roloff
