- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO) 6 and the Durham VA Medical Center (VAMC) in Durham North Carolina intend to contract by means other than full and open competition for Purchase Request 558-13-2-441-0014. 2.Nature and/or Description of the Action Being Processed: The Durham VAMC has an emergency requirement for dental laboratory services. A firm fixed price contract is anticipated. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The Durham VAMC has an emergency requirement for dental laboratory services. These services consist of fabrication of one or more fixed prosthesis on natural tooth abutments and/or implant abutments to restore the form, function, and aesthetics of eligible VA patient's stomatognathic system. Award of a firm fixed price requirement type contract for the period 14 June 2013 thru 30 Sept 2013 in the amount of $68,724.00 to Absolute Dental Service, 3600 University Dr, Ste C, Durham, NC 27707 is anticipated. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §253(c) (2), as implemented by FAR 6.302-2 "Unusual and Compelling Urgency". ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (x) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability Or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This requirement is for a service that was being provided by Durham VAMC at their onsite lab. The lab is currently under renovation and the service is not available at this time. The lack of this service is severely impacting patient care and causing long delays in providing dental care to the veterans. Absolute Dental has provided this service for the Durham VAMC temporarily in the past and is the only local company known that is familiar with the requirement and procedures of the Durham VAMC. They can immediately begin work and guarantee that prosthesis will be completed in 7 to 10 days. Patients can be appointed for insertion of completed prosthesis two weeks after initial tooth/implant preparation. The timely delivery of prosthetic services by a local lab will reduce the patient wait times and improve quality of care. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Due to the emergent nature of this requirement time does not allow for normal competitive procedures to be used. In accordance with FAR 6.305(b) this justification will be published on FedBizOpps within thirty days of award. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost for these services is $68,724.00 and is determined to be fair and reasonable based on recent NCO 6 competitive procurements. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: None due to urgency. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: As stated in paragraph 8 above due to the emergent nature of this requirement it is not in the best interest to the Government to solicit for full and open competition at this time. Doing so would cause undue delay in providing services to the veterans serviced by the Durham VAMC Dental Clinic. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section 6 above 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Due to the emergent nature of this action there was no time to promote competition.
