Description
Synopsis: This synopsis is provided for informational purposes and is not to be considered a request for proposal. The United States Army Contracting Command - Aberdeen Proving Grounds (ACC-APG) intends to solicit and award a Sole Source modification to Firm Fixed Price (FFP) Indefinite Delivery Indefinite Quantity (IDIQ) Contract W15P7T-11-D-T214 with International Enterprises, Inc. (IEI), a wholly owned subsidiary of Elbit Systems of America, 108 Allen Street, Talladega AL 35160-1399. This five year IDIQ contract was awarded 28 Sept. 2011 and has an ordering period through 28 Sept. 2016. The anticipated effort will increase the contract ceiling by $1.9M and add three additional NSNs to allow for the repair of 120 Improved Signal Data Converters (ISDCs) and 180 Flat Panel Displays under this National Maintenance Contract. These repairs are needed to sustain the UH-60M and CH-47F aircraft platforms to be able to complete their missions. Currently, these parts have significant backorders and no stock on hand, thus creating an urgent need for repairs in order to provide the necessary spare parts. ACC-APG is pursuing this action as Other Than Full and Open Competition - Authorized by 10 U.S.C.(c)(1) 23041 and FAR 6.302-1, Only One Responsible Source, as documented in Justification and Approval Document 13-122 dated 16 May 2013. The Government does not own any data rights for a signal data converter and heads up display and has no other mechanism for procuring required hardware items. The supplier has demonstrated that it has the proprietary design, data, production facilities and technical skills to produce the required hardware items. IEI has produced the hardware items, and successfully passed all US Army Air Worthiness Release (AWR) testing and certification. The Government attempted to buy the data, but the supplier was not willing to sell. Only International Enterprises possesses the proprietary technical data essential for the fabrication of these spare parts. Additionally, they are the only source with the facilities, including a test bed, and the technical expertise required to assemble, fabricate, and test the required spare parts. Without the technical data, any source other than International Enterprises would need to perform an extensive engineering design, followed by test validation. The design and test validation would result in delays of 20-24 months. If the procurement is not awarded to International Enterprises, the cost impact to the Government would be over $20M. International Enterprises can commence deliveries of required spare parts within 6-14 months after receipt of a Delivery Order. No other manufacturers have a similar product, and no other product can be accepted by the Army without Air Worthiness Release. The AWR process takes a minimum of one to two years. The Government has a significant back order and the need to sustain this system is very critical.
