- A.DESCRIPTION: This is a solicitation for commercial services prepared in accordance with the format in FAR Part 12, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested. Solicitation Number VA250-13-R-0682 is being issued as a Request for Proposal with the intent to award a firm fixed price contract for services. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-36. This solicitation is being published as a total small business set-aside solicitation. Service-disabled, veteran-owned small businesses and veteran-owned small businesses will be given preference. This is a solicitation for a multi-year proposal consisting of a base plus four (4) option years. B. STATEMENT OF WORK (SOW) for Radioactive Waste Pick-up and Disposal Contract Background Requirement Timely disposal of radioactive waste is necessary to comply with US Nuclear Regulatory Commission (NRC) and US Environmental Protection Agency (EPA) regulations. Failure to manage radioactive waste including timely treatment and disposal could result in regulatory violations, fines, and/or the revocation of the Louis Stokes Cleveland VA Medical Center (LSCVAMC) permit to use radioactive material under the Department of Veterans Affairs Master Materials Licenses issued by the US Nuclear Regulatory Commission. Timely disposal of radioactive waste requires a vender with NRC and/or NRC Agreement State licenses for treatment and disposal of radioactive and radioactive mixed hazardous (mixed) waste. A successful bidder shall have Department of Transportation (DOT) registration for transportation of hazardous materials and personnel who are certified as being trained for handling, packaging, and shipping radioactive and mixed hazardous waste. The radioactive waste disposal contract shall be for one year, with four additional one year renewal options. Introduction This SOW provides the specifications for a vender contract to provide radioactive waste packaging, shipping, transportation, treatment and disposal services for LSCVAMC. All vender transactions regarding radioactive waste shall be with the LSCVAMC Radiation Safety Officer or RSO designee (RSO). Deliverables The vender should provide a quote for packaging, shipping, transportation, treatment and disposal for each of the following radioactive waste streams generated at the LSCVAMC: Dry Active Waste - Radioactive waste without free standing liquid or EPA hazardous material. This waste stream will be packaged in 55 gallon drums according to waste profile requirements specified by the successful bidder. Deregulated Scintillation Vials - Liquid scintillation cocktail in vials containing tritium and/or C-14 at concentrations < 0.05 µCi/g. This waste stream will be packaged in 55 gallon drums according to waste profile requirements specified by the successful bidder. U-238 Solidified in Concrete - Depleted uranium generated from uranayl nitrate and/or uranyl acetate stock solution used for electron microscopy. This waste shall be solidified by the successful bidder within 5 gallon drums according to the waste profile requirements specified by the successful bidder. Deregulated Animal Carcasses - Containing tritium and/or C-14 at concentrations < 0.05 µCi/g. This waste stream will be packaged in shipping containers according to waste profile requirements specified by the successful bidder. Sealed Sources - Radioactive sealed sources licensed under 10 CFR Part 30 (e.g., Cs-137 > 10 µCi). This waste stream will be packaged in shipping containers according to waste profile requirements specified by the successful bidder. Sharps - Hypodermic needles generated by nuclear medicine and/or medical research. This waste stream will be packaged in shipping containers according to waste profile requirements specified by the successful bidder. Liquid Mixed Waste - Radioactive waste containing EPA characteristic and/or listed hazardous material. This waste stream will be packaged in shipping containers according to waste profile requirements specified by the successful bidder. Successful vender will schedule radioactive waste pick-ups at LSCVAMC upon notification by the RSO. The successful bidder shall demonstrate their capability of providing radioactive waste services according to this SOW. Additional deliverables to be provided to the RSO in conjunction with waste shipments include; NRC and/or NRC Agreement State Licenses - Provided for handling, treatment and disposal of each waste stream. Licenses will be provided to the RSO upon request and prior to scheduled radioactive waste pick-ups. DOT Shipping Papers - Provided to the RSO by the vender prior to each radioactive waste shipment. Shipping papers shall comply with all DOT, NRC and EPA regulatory requirements; and shall include the applicable DOT Hazardous Materials Declaration (49 CFR 172), and/or Uniform Low Level Waste Manifest (10 CFR 20, Appendix G). Return Manifest - Treatment/Storage/Disposal facilities involved with the treatment shall provide the RSO a copy of the waste manifest certifying receipt of the radioactive waste within 1 week of receiving the waste (10 CFR 20, Appendix G). Radioactive Waste Shipments The RSO will certify each radioactive and mixed waste shipping container for; 1)Radioactive content (i.e., isotopes and activity) 2)Hazardous constituents (i.e., EPA characteristic hazards or listed hazardous substances) 3)Physical characteristics (e,g,, Dry Active Waste without free standing liquid) The successful vender will provide the following; Shipping Containers - DOT certified shipping containers necessary for packaging/transporting the radioactive and mixed waste (49 CFR 178). Necessary shipping containers will be provided at the request of the RSO. Quote - Cost for packaging/shipping/disposal of each radioactive waste shipment. RSO will schedule radioactive waste pick-up with the successful bidder approximately two weeks prior to scheduled pick-up date. The vender shall provide a quote covering all packaging/shipping and disposal cost prior to receiving the radioactive waste. Radioactive and Mixed Waste Packaging - Including labeling and marking each radioactive and mixed waste container according to DOT requirements (49 CFR 172). Shipping Papers - DOT Hazardous Material Declaration and/or Uniform Low Level Waste Manifest necessary to transport the radioactive waste (e.g., 10 CFR 20, Appendix G). Radioactive and Mixed Waste Disposal Successful vender will; Return Manifest - Certifying the receipt of the radioactive waste by the Treatment/Storage/Disposal facility shall provide the RSO within 7 days of receiving the radioactive waste shipment (e.g., 10 CFR 20, Appendix G). The RSO will; Sign the DOT Shipping Papers - Certifying the contents of each waste shipment. Customer Service The vendor shall be accessible during regular working hours and ensure timely response to RSO inquiries. Billing Successful bidder shall provide the itemized cost for; oWaste containers oTransportation and Treatment/Storage/Disposal cost for each waste stream oOther charges Itemized invoice shall be sent to the RSO for each waste shipment. LSCVAMC will provide payment for radioactive waste disposal services upon receipt of invoice by the vender. PRICE/COST SCHEDULE PRICING: Offeror shall provide pricing based on one annual shipment of the following radioactive waste containers (one shipment containing one of each of the following radioactive waste containers). The total price offered shall include all charges. WASTE PICK-UPS: Waste pick-up shall be scheduled during working hours upon request from the RSO. The date of the waste pick-up may be scheduled according to the convenience of the vender (e.g., during scheduled milk runs); however, the date and time of the waste pick-up shall be scheduled with the RSO in advance and shall be within a two (2) week window of the date suggested by the RSO. The vender shall provide services and pick-up radioactive and mixed waste at LSCVAMC, 10701 East Boulevard, Cleveland, Ohio 44106 WORK HOURS: Monday thru Friday (except federal holidays) one shift - 8:00a.m. to 4:30p.m. Waste shipment pick-ups should be scheduled before noon during working hours. FEDERAL HOLIDAYS: The ten holidays observed by the Federal Government, i.e., New Year's Day, Martin Luther King Jr.'s Birthday, President's Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans' Day, Thanksgiving Day, and Christmas Day and any other day specifically declared by the President of the United States to be a federal holiday. E. SERVICE PERFORMANCE SUMMARY Critical Performance Evaluation Factors: a.Package Radioactive and Mixed Waste - Using appropriate containers and according to DOT/NRC & EPA requirements. b.DOT Shipping Papers - Provide RSO with shipping papers according DOT/NRC & EPA requirements for each waste shipment. c.Return Manifest - Certifying the receipt of the radioactive waste by the Treatment/Storage/Disposal facility shall provide the RSO within 7 days of receiving the radioactive waste shipment (e.g., 10 CFR 20, Appendix G). d. Emergency Information and Phone # - Included with shipping paperwork. Emergency phone number shall be manned 24 hrs/day 7 days/week during radioactive and mixed waste shipments. e.RSO shall be contacted immediately if there is a transportation incident involving radioactive and/or mixed waste from the LSCVAMC. Employee Training and Vehicle Registration - Vender shall maintain DOT training of employees and DOT Hazardous registration of transportation vehicles. RSO may periodically request copies of DOT vehicle registrations and/or training of truck drivers. 1. Quality Control: The vender shall package radioactive and mixed waste according to this SOW. The vender shall develop shipping paperwork to meet all requirements of this SOW including emergency instructions for transportation of the radioactive and mixed waste. 2. Quality Assurance. The RSO shall inspect all radioactive and mixed waste packages and sign paperwork offered by the vender to certify the content and packaging of the radioactive and mixed waste. 3. Surveillance Methods - The RSO shall be present to witness all radioactive and mixed waste packaged by the vender. F. PROVISIONS AND CLAUSES: This solicitation lists one or more clauses by reference with the same force and effect as if they were given in full text (FAR 52.252-2). The provisions at FAR 52.212-1, Instructions to Offerors-Commercial Items apply to this acquisition with the following addendum to the provisions of the standard provisions. In accordance with Federal Acquisition Regulation FAR 52.212-2 Evaluation-Commercial Items all offers will be considered for BEST VALUE. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforms to the solicitation and is most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers. (1) Technical capability. Provide evidence of DOT HAZMAT training and DOT registration of transportation vehicles. Provide a list of radioactive materials contractors and NRC and/or NRC Agreement State radioactive materials licenses for receipt, handling and disposal of-radioactive materials. Offerors will be evaluated to the extent which they provide information on their company's ability to manage the services described herein and how they propose to address all tasks in the Statement of Work. The proposal is to include a description the vender's DOT Hazardous material training program, quality and timeliness of their past performance, compliance with appropriate regulations, and other information that will assure the Government that your company has the resources to perform the contract requirements should they be selected to perform this contract. (2) Past Performance: Offeror shall have relevant experience in providing the same or similar services. Provide three most recent and relevant references that are likely to respond to our request for information regarding your past performance. References should include company's name, location, e-mail address and point of contact information. The references should be very familiar with your company. The Government may contact the offeror's references for information and may review performance ratings on file for prior Government projects the offeror has performed. Past performance with Government facilities is preferred. Past performance information obtained from sources other than those identified by the offeror may be used. (3) Price: Quote for each line item, including but not limited to the requirements listed above. Technical and past performances when combined are significantly more important than price. NOTE: The Government reserves the right to award without discussions. Vendors shall submit their most favorable terms. F.
