- Justification for Other Than Full and Open Competition This Notice of Intent is NOT a Request for Quotation (RFQ) for competitive quotes; however, the Federal Emergency Management Agency (FEMA) intends to award a sole source purchase order based on the authority of FAR 6.302-1 "only one responsible source and no other supplies or services will satisfy agency requirements". FAR 6.302-1(b)(1) states this authority shall be used, "When there is a reasonable basis to conclude that the agency's minimum needs can only be satisfied by -- (i) Unique supplies or services available from only one source or only one supplier with unique capabilities...". FEMA intends to award this purchase order to Atlantic Emergency Solutions, Inc. for annual remedial maintenance and emergency repairs, as well as pump and ladder testing on its' Pierce fire apparatus vehicles which are considered commercial services in accordance with FAR Part 2. This action is being performed in accordance with FAR 6.302-1(a)(2) which states, "When the supplies or services required by the agency are available from only one responsible source,..., and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for." A Justification for Other Than Full and Open Competition submitted by the Contracting Officer's Representative (COR) and approved by the Contracting Officer is provided as an attachment to this notice. DHS/FEMA/MWEOC, Emergency Services Division's Fire & Rescue Branch has a requirement for annual remedial maintenance and emergency repairs, as well as pump and ladder testing on its' Pierce fire apparatus vehicles. These services include performing detailed heavy maintenance and repairs to all generators and testing fire apparatus aerial and ground ladders as necessary to meet or exceed National Fire Protection Association (NFPA) standards. All work shall meet Pierce specifications and be performed by Pierce certified master technicians. The Contractor shall also be responsible for providing on-call emergency roadside repairs to include on-site service and towing if necessary. The period of performance to be established for these services shall be a one year base period and four one-year option periods. Sustaining the optimal operating condition and reliability of DHS/FEMA/MWEOC's Pierce fire apparatus vehicles is a major concern for the Emergency Services Division's Fire & Rescue Branch. establishing a high quality maintenance program to be performed by Pierce certified master technicians is vital in order to prevent downtime, ensure warranties remain valid, and sustain optimal equipment performance. These essential services are not available from sources other than Atlantic Emergency Solutions, Inc., a Pierce Platinum Battalion Dealer, which provides Pierce certified master technicians. Proprietary software provided by Pierce Manufacturing must be used to diagnose equipment deficiencies and resolve complex malfunctions. Atlantic Emergency Solutions' service centers feature EVT and ASE certified technicians who are highly trained in diagnosing and repairing fire apparatus vehicles. They have a fleet of mobile service vehicles capable of providing roadside emergency repairs. They also provide on-site maintenance and repair services which results in additional cost savings to the Government because the fire apparatus vehicles do not need to be taken to the service center; most maintenance can be completed, "on-site", at the MWEOC. Since Atlantic Emergency Solutions is a Pierce Service Center, they maintain an inventory of readily available replacement parts which results in reduced apparatus downtime. This accelerated level of service is crucial to ensure repairs are made expeditiously. In addition, Atlantic Emergency Solutions, Inc. is the only local authorized service provider for fire apparatus vehicles manufactured by Pierce Manufacturing, Inc. There are other Pierce Service Centers; however they are located over 100 miles from the MWEOC. Thus, in accordance with FAR 6.302-1, Atlantic Emergency Solutions, Inc. is considered the only responsible source for providing annual remedial maintenance and emergency repairs, as well as pump and ladder testing on MWEOC's Pierce fire apparatus vehicles. FEMA is unaware of any other sources capable of satisfying DHS/FEMA/MWEOC requirements for these services. However, any company capable of providing an equivalent level of service may submit a detailed capabilities statement in order to allow the Government to perform an evaluation of your proposed services. Capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination not to compete this proposed procurement based on responses to this notice is solely within the discretion of the Government.
